can anyone help me answer a legal question?

    so SWIM was wondering what the penalty for possession of shrooms with intent to distribute is in Tennessee? and then the penalty for manufacturing...

    ive looked on the net an all i can find is for simple possession its a class a misdemeanor,and im not even sure if thats correct,i cant find anything else..

    In Tennessee, manufacturing, delivery, selling, or possess with the intent to manufacture, deliver a sell of a schedule 1 substance (shrooms) = Offense/Penalty: Class B Felony. Fine of not more than $100,000; jail time of 8-30 yrs.

    So it's a minimium of 8 years if convicted.

    However, if it fell under federal law... Trafficking of a schedule 1 or 2 substance = First Offense (Any amount ): Not more that 20 yrs. If death or serious injury, not less than 20 yrs, or more than Life. Fine $1 million if an individual, $5 million if not an individual.

    So 20 years minimum in a federal case.

    My friend got caught with a giant bag of shrooms that where not even his but the hotel room was under his name so he got busted for it. He was charged with a felony but they dropped it down to a misdemeaner cuz its his first offence and he only had to do a year probation.

    OUCH,, well thats to bad.. i guess i got some really BAD news to relay..

    i dunno,, from what i understand its a state warrant.. ive never met the kid,its a friend of a friend.. some kid.. 18..

    i guess they were tryin to tell him to get a lawyer an turn himself in.the cops found a quarter pound of weed and a half pound of shrooms as well as scales and all the usual dealing paraphernalia in his apartment.

    they said his warrant had manufacturing on it as well,however i guess they say he claims he wasnt growing only selling.. i guess that point is kinda irrelevant now huh??

    what i understand is he is already on probation,,lesser charges dont seem likely in this case..

    well thanks for the info,, i guess i got a really depressing phone call to make now.

    Ouchy. With a good lawyer I'm sure he'd be looking at significantly less time. Some sort of plead guilty to this and we'll drop that kind of deal. But they probably won't settle for less that intent to distribute, if they actually have a manufacturing charge on him. If they don't, he might bargain down to possession (with a good lawyer).

    Of course the first thought that popped into my head was...run like hell! I guess that's not really a long term plan though. Maybe his lawyer can fight the warrant they had to search his apartment. Yuck.

    i really dont see why america doesnt legalize all drugs since they make a hell of a lot less money enforcing the law like ALOT..they could use a clean needle program for those injectors and open like a heroin users annoymonis(sorry didnt pay attention in english class) limit how much of something some1 can buy possibly tax the hell out of herroin so they could open rehabs for it and what not. it would also bring down gang violence since thats the number 1 way gangs make their money so if people can buy it from stores why would they buy it from dealers? other than it's possibly cheaper by a small amount

    i wouldnt have thought of that but if he doesnt want to go to prison for however many years maybe canada or mexico is lookin better and better

    Yeah, but if he's a white guy who speaks no Spanish, with little money, Mexico is out. As for Canada, I'm not sure but I suspect he would have a hard time becoming a citizen, with the US charges pending. I'll ask my boy who just became a Canadian...

    Here's the response that I got from my Canadian friend:

    By running to Canada do you mean crossing the border illegally? He runs the risk of being held at the border if he has warrants out on him, in which case he would be fkd if they pulled him in. I'm not saying he would be busted for certain, I've driven thru quite a few times and they haven't even asked for ID. But, I'm always prepared.

    Anyway, regardless of whether he got here legally or not...he would definitely need criminal background checks (both state and federal) too eventually become a legal citizen. Technically, as a visitor, US citizens are granted 6 months stay. After that you have to apply for an extension. There are ways around that though...I never applied for one.

    Legal work is out of the question without a work permit or a work visa...both require some sort of background check. There's always under the table stuff tho. To be blunt, I think one could theoretically come here and live their entire life without becoming a citizen and no one would ever know. There would be obvious sacrifices you would have to make to do so, (healthcare, etc) but I think it could be done. Millions do it in America.
