Has everbody heard that the CITY of Denver, not the state of Colorado, has voted to legalize marijuana as an alternative to alcohol. There would be guidelines set, such as 21 age limit,no DUI/DWI, transport of no more than 1 ounce in an auto, and 3, or something like that, in your home, and no public use. Apparently it was effective yesterday.
huh? how would they set marijuana as an alternative to alcohol, and then not set any guidelines for it? sounds like bs. do you have a link?
I live by Denver the cops say they won’t follow the law, goes to show how much the work for the people. But it has been an infraction for years a $75 ticket and you don’t have to appear in court, the cop usually don’t bother with it. So not much to worry about so Smoke away no worries.
how can cops say that they wont follow the law? they can't do anything to you if it isn't illegal anymore.
Yeah it’s bullshit.. I’m not to sure about all the legal stuff behind it I just know that the people voted to legalize it and the police refused to accept it some how. I think it was something like they will still follow state law instead of the new city law? Not sure but all the legal experts are encouraging people to go fight the tickets instead of paying them and hoping that will discourage the police from writing them. Colorado is making a lot of progress in the legalizing of marijuana a few medical marijuana patents have gotten their plants returned and are suing the police. There is a few battles being won on a couple of different fronts.
well which cops are we talking about? the city cops or the state cops? I could see a state cop still issuing tickets and being in defiance, but a city cops should be enforcing city law, not state.
^I’m not sure but I think it is the city cops that are refusing to follow the laws I think I remember hearing the Chief of Denver police talking about it. It is just a good example of the police not following the law and the votes of the people. Law enforcement out of control..
that's not even possible. city cops can't just enforce their own law. especially a law that is in direct opposition with that of the city. how would that even begin to stand up in court? also, they should then be prosecuted for unjust arrest. sounds like they have a major need of lawyers in that town, and I dont understand how the police or the judicial system there could be so stupid.
I saw it on the "growery", sister site to the "shroomery", launched on 4/20, it was early a.m. when my husband saw it, and read it to me. I've been looking for the article, but no luck yet, hubby is at work, he might know when he comes home. The bill was passed in 2006, but hadn't fully taken effect until this month. Not sure if they are still referring to actual possession, or smoking as well (which was still illegal in 2006)....also, it would be easy for cops to arrest people if possession was legal and smoking was not, they are all twisted and could find a way if they want to. Also it depends on where you live, not all law enforcement and judicial systems were created equal.
Here is what Mason Tvert said about it he is a lawyer and the one that started the whole thing going to get it legalized. “Tvert, who headed the campaign to legalize marijuana in Denver, said the city has a right to implement this law and prosecutors have the right to choose which individuals to charge and under what law. There have been cases in the past where a city law was upheld by the court even though it contradicted the state law, he said. The argument that state law overrides city law is false, Tvert said. It is the job of the court to decide what law supersedes another. Colorado state law considers possession of an ounce or less of marijuana by an individual age 21 or older a class two petty offense, punishable by a fine of $100 or less, he said. If individuals are prosecuted under state law in the future, it could lead to court cases, Tvert said, and SAFER would assist individuals in finding legal representation and help with their court fees” LINK http://media.www.udreview.com/media/storage/paper781/news/2005/11/15/News/Denver.Passes.Legislation.To.Legalize.Marijuana-1057101.shtml I thought the part where the SAFER origination will help fight charges is cool. Here are a few more links to articles on it. http://www.jointogether.org/news/headlines/inthenews/2005/denver-residents-vote-to.html http://www.usatoday.com/news/nation/2005-11-03-pot_x.htm
I never said that city law overrides state law, or vice versa. but a CITY cop should be concerned about the laws of the CITY, not those of the state.
^ yea man I understood what you mean and I agree completely with that... That's how it SHOULD be.. yes
