My poor little nephew is SO screwed! His 20 year old brother got jumped Saturday night and got hit across the face with a beer bottle & wound up with a broken nose. So his brother calls him this morning before he went to school and begged him to buy some pain pills for him... he bought 14 pills, some lortab 10's and something else (imnot sure yet) and the fucking school got raided by the cops this morning. I feel so bad for him.. .he turned 17 Sunday so they are charging him as an adult... one count of possession of schedule 3 narcotics, one count of possessing a controlled dangerous substance. The local authorities have him now and they are bringing him to the parish prison at 3 oclock and they are going to release him. I'm waiting on an attorney to call me back but we are pretty sure there is a mandatory minimum sentence for possessing drugs on public school grounds.... so he is definitely going to serve time. The scary part is,,, he's getting out of jail today, and it will probably be at least 6 months before his case is presented to the court,... once he understands that he is going to serve 5-10 years and he will never be able to hunt again,,, he is really going to fuck something up.. . more than likely himself. My mother n law is in shambles because they don't even know what to tell him when he get's out... they are scared of how he will react. poor dude... if you pray, say a prayer for him. thanks

what bullshit. honestly. who did he harm? WHO? no one, that's who. and never to hunt again? WTF does his right to put food on the table have to do with him messing around with some ultimately harmless chemicals that people are gonna get anyway?
oh man,,, you don't know... he's probably going to kill his brother then himself. this little dude is really crazy, when I lived there I tried to work with him as much as I could but he would click and just go off,,, 99% of the time he's the best person you could ask for, but the littlest things would set him off and he would just go absolutely fucking nuts,,, he's shot at me across the field with a 22 twice, attacked me with bats & rakes... he's really got some bad problems because that 1% of the time he has no control of his actions. I would say prison is the best place for him but he will be like dealing with a full blown monster when he get's out. This will probably set him up to spend the rest of his life in prison,, because when he get's out he will be on probation and I know he's going to pick up a gun and go hunting... .that is without a doubt his favorite thing in the world.
shouldnt be a crime when 10% of americans have been on some sort of pain killer, legally. He needs a good lawer.
ultimately it comes down to this... a)the brother in question should NOT have asked the 17 year old to "buy" street prescription pills...the 20 year old should have gone to a doctor, told his story, and gotten pain meds that way...it was irresponsible of the brother in question to ask such a thing of the 17 year old...common sense was not present for some reason... b)this isnt 1997 anymore, schools get raided and cops are crawling like malicious spiders in schools now...when i was 17 i did whatever i wanted on school grounds because the penalties were FAR more lenient back then and cops only got called to a school because of maybe a bomb threat or some dumbass dropped a half ounce of chiba in the hallway... c)im sorry to sound like a hardass but...all parties involved fucked up severely and i have minimal sympathy...raids, court, jailtime, and heartache could have been EASILY avoided with five seconds of thought...and the painmeds could have been aquired legally...and if insurance or lack thereof is an issue...i have no insurance myself...when i had a tooth pulled in august my pain prescription was like $20 or something of generic codiene...seriously...its too bad really...
That really is a shitty situation. What state are you in? I'd say with 99% certainty that he won't spend over a year in jail, if that. What kind of history does he have with the police? Is this one of his first offenses? If so, that should help a lot. 5-10 years just doesn't sound right, I know someone who got a 7 year sentence for killing someone. Then again, the laws might be different where you live. When I got in legal trouble, I went on all the websites I could find that had information related to paraphernalia, and I was able to find lots of info on sentencing guidelines. Hoping the best for your nephew.

I'm waiting on a guy I grew up to call me back, he's the assistant district attorney and he also has a private practice. But if there is mandatory minimum sentencing.. I don't know if an attorney will do him much good. His grand parents really don't have that kind of money. Without a doubt ! My first question was "why didn't he just go to the doctor and get his own prescription???" and you definitely don't sound like a hard ass... he's just not a very bright kid. He had more than enough time to drop the pills in the trash,,, just stupid I guess. He's in Louisiana, and he's been in a bunch of trouble leading up to this. He got a marijuana possession charge at 15 and he's been in juvy for fighting a couple of times.
I don't know yet,, it's two seperate charges, so I'm pretty sure they will each carry a mandatory minimum. The fed's passed a law a couple years ago concerning possession of drugs on school grounds... I'm sure it's pretty fierce.
I talked to the attorney's secretary that I grew up with and come to find out he's the city prosecutor, so she gave me a few recommendations and I talked to two different attorneys. If he doesn't get good representation and try to make some kind of deal, the mandatory minimum sentence is 15-20 years for the schedule 3 on school property, and 10-15 for the controlled dangerous substance on school property..... I know that sounds outrageous, but possession of drugs on school property is obviously a very serious crime to be charged with. It doesn't surprise me tho', there is a "1 to 100" law on crack cocaine.... I met a lot of first offenders in prison serving 5-10 years for ONE rock . The way the law is worded, if you get caught with 1g, they charge you with possession of 100g... and it carries a mandatory minimum sentence. I guess they are breaking it off in people's ass when they get popped on school property too. Both attorneys said the same thing ... "why didn't his brother go to the doctor and get his own pills?? " Stupid ,,, stupid stupid stupid !

I feel sorry for your nephew. He may have been stupid, but stupidity shouldn't result in 10+ years in prison. I have no time for these type of zero-tolerance laws. There should always be discretion used in judging every case. Obviously, the drugs at school thing must have been getting outta hand for these laws to be introduced in the first place. When I read about things like these, I'm glad I don't live in America.
He hasn't been released yet... hopefully in the morning before "jail call" and the judge sets a bond on him. The jail is overcrowded and I know the associate warden there... she told me today that they were going to cut him loose, we just weren't expecting him to get to the prison so late at night. If he gets out without his grandparents signing a property bond... he might be exploring a new country soon !
