Midnighttoker, you were raped and used. Rape is having sex with someone without their consent you did not consent. Even though you did not use your best judgement he is responsible for his own actions and not yours.

I understand what you may be going through because I to was raped by a family member when I was 14 and talking has helped me. Please find a counselor to talk to and they will help you with your emotions and possible legal action. If you want to talk leave me a private message.

 

What about this hypothetical situation.

I go to a party and get completely drunk, I am stumbling around then this chick leads me into a bedroom and starts to take my clothes off. I am to drunk to stop her or even care. She fucks me then I wake up in the morning naked as she is leaving the bedroom. I say "hey what happened", she turns to me laughs then walks out never to be seen again.

A girlfriend of mine was in the same situation just this week. She was really drunk, and she had sex with this guy...The thing is she woke up remembering nothing. She filed a report and he's in custody right now. I don't know if it was rape or not, because she was talking during the incident, asking if he's wearing a condom...trying to put her pants back on.
However, the next day she says that she had no idea what she was doing. She was also drunk to the point of puking, also she couldn't even stand up or walk. So I don't think in that state you are able to consent to sex.
But is it rape?
