Your best bet is to go the route of the constitution. Proving it wasn't anything you could smoke, get high off of, or enough to be considered. Hire a lawyer and bring up the lohan case, etc. It may sound like money for a lawyer but its better then having anything on your record. Trust me I know. I sell for a living. I can't get a job anywhere besides a local car wash because of a few felonys and mistameanors and a good lawyer I'm out of prison.
