Can you get arrested for just being high?

Like if you're high in public but have no weed on you, are you good or can you still get arrested?

 

weed no you can even tell a cop i just smoked my last joint
however if your like high on pcp or something that causes a public disturbance u sure can

Well they dont really have any way to prove that you're high, and they cant do anything without probable cause for.......

So dont do anything stupid, and it wont really matter what the law is.

If you're goin around advertising your high, then you probably should get in trouble.

 

Heh good question, I've never thought of that. Doesn't really apply to me though cause chances are if I'm high I've got some weed or a pipe in my pocket.

 

Even if you're giggling like an idiot in the car with eyes as red as the sun, if they search you and can't find anything you're in the clear.

if they catch you smoking its illegal if you tell them i just smoked, its not
its only illegal while in the process, but once the deed is done they cant touch you
same with possession
if u have some they got u, even if they can prove beyond sa doubt that u had some momments ago, they cant touch you

No way, they can't arrest you for just being high. But, they can really be a buzzkill which isn't that good a thing either.

Driving while high can be considered driving under the influence. By the same token, if you took a few painkillers and you're driving like shit, that's also DUI. In my experience, you'd have to be pretty lit in order for MJ to hamper your driving. The police have an obligation to take you off the road if you're a threat to other people, and I totally support them in that role.

If they catch you while smoking, technically that's posession. If they bust you, it's for that. It's not actually illegal to smoke pot. Just to have it, or sell it, or buy it. Though buying it, I'm not 100% sure of. That might fall under posession as well, at least in some areas.

 

Sounds good- but look at NORML's post on it on under the NJ section of the site (where i reside)- "Possession of 50 grams or less of marijuana or being under the influence of marijuana is a disorderly persons offense, punishable by up to six months in jail and a fine of up to $1,000."

^ says there that being under the influence aint such a good thing...

 

Jersey laws look pretty shitty.

Despite how much I may bitch about living in New York, I am thankful the laws are very chill (compared to most states), with it being decriminalized and all.

Just a civil citation and small fine for first and second offenses for small-time posession. None of that DUID shit either, though I do agree with the previous poster, if pot is affecting your ability to drive the car safely, you should be taken off the road.

 

In canada, if you got the biggest prick of a cop while stoned, they could toss you in the drunk tank, but that would be extremly rare.

 

In Vancouver there's homeless people that get high 24/7 so I don't think the cops care too much about middle classers getting high

 

Yes they can - they can get you for public intoxication <- and they have a broad umbrella coverage for that definition. Mind you its only "technically" possible and at the worst they take you to the tank until you are straight maybe a wee fine.

But as someone said its only if you are acting like an ass.

 

you probably wont get arrested in most cases, but you sure can get harassed if that's what the cop feels like doing.
