and i was gone for the weekend. I come back on Monday to find out my best freind has gotten busted over the weekend. Him and three friends were just parked on the side of the street in his car talking, and yeah we do smoke in his car alot, but at this time they were doing absolutley nothing wrong, they werre parked on the street down the street from one of the passengers houses, and they were just talking. I guess somebody in one of the houses on the street called the cops because it looked suspicious, so a cop pulled up and asked my friend what they were doing there. My friend said they were just talking, and the cop asked if he could search the car. My friend said no, for what reason>, and the cop repilied i have plenty of reasons, now get out of the car, and he proceeded to call for backup to thoroughly search the car. Under the seat they found a handle of Captain Morgans, and htey found my friends bowl. They are chargin him with transportation of alchohol by a minor, and he just got his license one month ago, and he is 17 years old So my question is, how long do you think he is going to lose his license for, and did the cop have any right to search the car?

yeah if he said no, and the cop did it anyway, the evidence will be thrown out in court regardless of what they found. if they brought the dogs out and the dogs alerted to something then hes fucked. just have him tell his lawyer that he denied the search but they did it anyway.

I'm sorry but as someone who has gone through the court system, and studied my rights as well as the cop's; he's fucked. Cops if they'd like to, can do almost whatever they please. This isn't a murder case where tens of thousands of dollars are spent on lawyers and prosecution. Most likely the county will charge him with some bs, he'll plead it down to a drug class, possibly probation and or community service, and of course the reason for it all...hefty fines. The cop could say that the kid had too many people in his car on a provisional, he could claim to have smelt a lingering cannabis odor, or he could even claim to have seen them hiding the alky.
o i just learned they are only chargin him with the transportation of alcohol by a minor, and yeah he was drivin with people before the rule that u must wait 6 months to drive with others under 18
