Is breaking curfew enough reason to be searched?

I hang out at my friends house (like 40 minutes away) lots of weekends, we cruise around a lot after 12:00am an I'm only 17 while they're all 18. Usually I have weed or a piece on me so my question is, if I get busted for being out past curfew, could they detain me and legally search me? Or can I not be detained for breaking curfew?

 

yes they can and more than likely will. 3 of my friends were ridin around town one night after midnight 1 was 18 one was 17 and the other was 15. the 17 year old was drivin and they got pulled for havin a tail light out and they said yall know its after curfew and they were like yea we were just heading right up the road here to a friends house for the night (lie lol) and the cop was like i think u all need to step out of the car for a minute and they all did and they searched the car and found half a j and a box full of roaches the 17 year old had been saving since it was his car and the 15 year old had a blunt wrap and the 18 year old didn have anything but was high so they took em all in and let the 17 year old go called the 15 year olds mom to come pick him up and made the 18 year old spend a night in jail

 

What the fuck? There's a curfew?

i never knew places at curfews. i thought parents just gave them to their kids, or people who have been arrested for asbos got them. so strange...

plus wtf, 9pm is so early! it doesn't get dark until 10pm in summer. shops are still open then... imagine if you went to get some chips from down the road and you got arrested. lame.

 

Christ. That's ridiculous. I was also under the impression that it was just a parent/kid thing. The future does not look bright.

 

i know. authorities are getting so much stricter with kids these days. imagine how shitty it will be for the teenagers in 2020! :/

 

theres always been a curfew
it really depends on where you live
legally they can't search you without a warrant, in canada our charter of rights and freedoms pertects us (section 7 if ya wanna get technical)
they can only search you if you give them permission to do so, often they use their sense of "power and authority" to get kids to let them

 

gah, that seems fucked up to me. they should just talk to kids if they're out really late and ask them what they're up to.

yea its bullshit around here lol ppl usually just hang out at the bowlin alley and deal n shit like that and then when curfew rolls around we head back to one of our friends houses and party there lol

 

The curfew in my state is 11 for kids 16 and under, but I've never even heard of anyone getting in trouble for being out later. I think in most places it's just around so the cops have an easy way to make kids they know are up to something go home.

I live in minnesota, so it's not a huge deal if I get caught with weed, and the cops around here usually are pretty chill. But yea, curfew is bullshit, you Europeans know what's up. I look pretty old, older than some of my 18 yo friends, and I've been seen by cops after 12 just walking around and don't have any trouble. Just if we got pulled over randomly by some bored cop then that would suck.

 

WTF, curfew? i thought that died a long time ago. curfew would suck, no going out to get chips past a certain time!? dude!?

 

Well, where I live, it's only a curfew for drivers with their provisional license.

 

just because it isn't enforced doesn't mean that there isn't a curfew...theres alot of stupid laws that are in the system...most of them aren't enforced but if some shit head cop wanted to he/she could
one of the stupid laws that i always remember is that it's illegal to drag a dead horse across young street in toronto during specific hours
most places don't enforce curfew unless they want to be dicks, but there still is and has been (for a long time anyways) a curfew...

 

Around here the curfew for 12 and under is 9 and for 13-17 its midnight. And one of the larger malls, that has a movie theather in it, starts carding at 10:00 or so to make sure no one's breaking curfew...yeah its the most insane thing ive ever heard.
