Ok, ok, to end the great party bust dispute, a cop does not need a warrant to enter a house party in the states. If they know that illegal activities are going on inside, can smell weed, see beers being drank, ect ect., and suspect that there are minors in the house, they can bust the party without a warrant. The reason for this is that if there is under age drinking going on, which is most deffinatly going on at a house party, the police can bust in on the grounds that minors may be in danger. Wether that be alcohol poisoning, stachetory (sp?) rape, or somebody passed out on the floor, it doesn't matter. Just finished a semester of government, so our teacher gave us the down low on all the cop busts and what's legal/not. =)
I don't think so. If they look at people in the house, how are they supposed to know they're minors? They're "hunch" is not sufficient evidence for a search. Also, cops NEED a warrant to enter a house. IT DOES NOT MATTER IF THEY HAVE PROBABLE CAUSE. But, if they knock on the door and you open it and they see weed, you're fucked.
if anything illegal is in clear view they can come in, if they just see beer cans then they'll usually ask to see the owners of the house and ask for their ID's, not sure if you have to agree but they'll usually bust your balls until you do anyway, or they'll just find some other way to fuck you over.
In many states, my own for example, there are laws saying that if police think there is underage drinking going on they're allowed to go in, also if a cop comes and knocks on the door and there's a good party going on, in alot of houses they're probably gonna see something just from the door.
I'm wondering if that counts for obstruction, cause I know you have to answer for police, you don't gotta let them in, or even the door all the way, but you do have to acknowldge them.
^All kinds of bad things happen when you pretend to not hear the cops. It would almost definitely make the situation worse. FloydJunky is right to the best of my knowledge. Also, I'm pretty sure that they can come in on the probable cause of something like a phone call from your neighbors.
cops cant come into ur house unless there is clear evidence that ur doing something illegal or someone is in inminent danger...if u know ur not breaking this u can go ahead and answer the door naked,and if u dont answer the door they definitely get pissed off even more
Okay, let's clear this up. Cops (the ones you deal with, not the feds, they have their own laws) can enter private property under a couple of cirumstances. One, the most common, is that they are given entry, (do you mind if we come in for a bit?). Never allow the cops entry into your house, remember, they're like vampires: they can't come in unless you invite them. Secondly they could see illegal activity from public property. this means that if you lean out your window to smoke a bong you could be fucked, or if you stab some one on the porch. Thirdly, Cops can enter private property if they are chasing someone else. This means that if someone escapes from the police and runs into your garage, the police are allowed to enter the garage and can then use any evidence they see in court. Fourthly, They can enter property if there is a clear and present danger. I.e. the house is on fire, there are terrorists trying to blow up the house... etc... They cannot gain entry to your property based on a phone call from a neighbor. Phone calls cannot even get them a warrant. Noise complaints, however, allows them to go to the house, knock, and cite the owner of the house for the noise complaints. This is usually where they gain entry because someone lets them in, or they see something. I've never heard about that whole suspecting minors thing before, and it sounds completely unconstitutional (any cop could then get access any piece of private property without a warrant), but i'd keep an eye out for it until it makes it's inevitable progress to the supreme court. P.S. If you are intoxicated, do not go outside to talk to the cops, talk to them through the screen door. If you are intoxicated and go outside they can and (by now they are probably pissed you wouldn't let them search) will get your for public intoxication.
the fastest way to get out of any trouble quickly is to aswers some basic questions and give the cop an excuse and ask if ur "free to go" he has to let u go unless he has proof u did something..i like cops they r cool but to some assholes u gotta fight law with law
So a cop looks in a window, sees someone gettin hacked to bits, they have probable cause, you think there not busting into that house? gimme a fuckin break dude, it's harder for cops to get into the house than a car without a warrent but they can and they will.
