After reading mountains of nothing but sounds like a band of children escaped from the day care being given a computer to blast thier rants upon I figure I could do about the same. Time for people to stop believing that thier goverment no matter what party actually gives a shit about anything but that fat leather item in their back pocket. Republican, Democrate, shit any party is in it for the $$ and that is the cold hard facts. Our country is piss poor broke not only becuase of shitty management but also becuase for the most part we are a bunch of spoiled fucking brats. 4 Wheelers, multiple TV's, DVD players, Computers, 2 or more cars, Boats, Seadoos, vactation homes, shit the list is endless and the kids growing up today demand more and more, parents being to spineless to tell them NO and goverment agents (Child Services) not letting them tell them no or be called a bad parent. I love the fact I hear teenage brats telling the world that they have to fix the problems of today. Yup thier parents should nevr have spoiled them kids, they should have given them real chores to do and supplied them with sense of pride on a job well done not based on brand names and toys they have. Stop running them credit cards up and then thinking you can just go to court to get rid of your debt, you should go to prison for that, its worse than a bad check but is allowed. Stop lawsuits to pass blame for your stupid mistakes. Live within your means, work on making your home better for the world instead of thinking the goverment owes it to you, start making some sacrafices to better your life than sit here and cry boo hoo, poor us, the un employed teen who finds it easy to complain and never contribute other than saying others need to fix it for them, GROW UP!
I think your premise is good Yank, but it's should also be held for Corporate interests as well. Why should they be protected from responsibility for the safety and efficacy of their products while the little man is made harmless by legislation?
The first step in the right direction should be tort reform. We get laws protecting businesses because there are so many valueless suits against them, and often they pay huge awards for their customers' lack of common sense (remember the MacDonalds hot coffee suit).
Agreed, but common sense goes hand in hand with personal responsibility. If Kathleen Gilliam hadn't tried to drink coffee while driving, and if she hadn't spilled said coffee in her lap, and if McDonalds had simply spent a few dollars to cover her medical expenses after she was badly scalded (in which case she claims she would not have filed suit) and if the lawyers hadn't jumped all over the case, and if worms carried machine guns birds wouldn't fuck with them. I'm no fan of the corporate world. Tort reform is necessary but money hungry asshole lawyers and litigious citizens are still to blame. Most corporations are very aware of targeted liability and some do their best to deal with people on a case by case basis. But many are also aware that if they pay out $3000+ in medical bills to some clumsy oaf who should know better than to try to sip coffee while operating a motor vehicle, they will have 500 people lined up for a handout the next day. You have to draw a line somewhere. The cost of liability insurance and malpractice insurance is a big part of what is causing the cost of living defecits that we ALL are facing. This is the reason the a 5 cent cup of coffee costs $2. Judges and juries should make individuals responsible for (not) exercising common sense and this entire madness needs to be legislated.
Perhaps those of you that cite the MacDonalds case should read this: http://lawandhelp.com/q298-2.htm If you read the link you will see that MacDonalds was preparing their coffee 20 degrees hotter than other restaurants. I think the facts point out that this was not a frivolous law suit. There are way fewer frivolous law suits brought than most have been lead to believe. Corporations would like you to think this so that they have no liability for product safety or efficacy. The reason a cup of coffee now costs 2.00 is because so many are willing to pay Starbucks that amount instead of making a pot at home. The market will charge what the public is willing to pay.
How many other "valueless" lawsuits can you people cite? Please I would like to research them for myself.

I see no citations on either page as to case numbers, court or principles named, it's hard to dispute that these sort of things actually happened when the facts of the matter aren't stated. It's easy to state that something happened without providing the necessary materials to back up said statements.

Are our kids or even the poor responsible for these things. I don't think so. I think the rich and those in power are. Will they ever be held responsible?
