Good god I've just been raped by the system!!!

    Sorry guys, but I have GOT to rant!!!!!!!!!!!!!!!!!!!! My adrenalin is thru the roof, and I am madder than the frigging hatter. I've felt it coming for a while, closer and closer. The fucking evil thats floating around. You know, that thing that seems to be making this world a worse and worse place to be. People getting crazier and crazier. OK enough of the repetative stuff. We just had a rather BAD visit from the local and not so local "public servants". Armed with a search warrant for the farm. I read the damn thing 3 times. It reads like a damn fairy tale. Everything on it was a fabrication by some teenagers who I dont even know who they could have been, who got in trouble with a bag of weed earlier today and had the BALLS to claim that they had gotten it HERE from my son, who just happens to have been in jail for over a month... They stated that they had been here this morning and got the weed from him, and saw a quantity of weed while they were here. Well, if they were here they were fucking invisible....
    Apparently, the cops can get a search warrant for your place based on just anybodys statements about anything they can dream up, and the police don't even have to check to see of the statements could be credible or not. So, here they come, all 4 carloads of them, and went thru the house and the barn, smashed out a car window after being given the keys, Caused some other damage, found our personal garden and a couple pipes...

    Well, here's what they DIDN'T do. They did not arrest us. They did not take my old mans guns, they did not take our money, hell, they didn't even search the house well enough to find our stash. They just took a statement, "all for personal use", said have a nice day, and left...

    Does anybody know what the real laws are about obtaining a warrant? Don't they have to have something besides just a lie given by two minors?
    Damn, I won't sleep tonight.

    Earthmother-I really don;t know on that as it has been a while since it happened to me-It sounds like overkill though and you might call a lawyer in your area-It should be free just for a 5 minute phone call-Some of those laws are different state to state. I;m glad they let ya go for sure-You may want to find out how much is legal or only a fine -Probably less then 1 oz.-You also may want to get a big noisy dog-

    That's horrible... they broke you're car window? That sounds entirely inappropriate, and why were there so many of them?

    Good luck getting your peace of mind back... I'd be in a really pissy mood for a while if I were you.

    Drug sniffing dogs can tell the difference between catnip and cannabis. Usually, when you are raided they take everything that looks like herb and every powder and subject them to lab examinations. Giving weed to the cat will not food anyone.

    I am sorry this happened to you. A good lawyer, with Civil Rights and false arrest experiece is your best bet. Don't take the word of people who "knows somebody who did this or the other thing and got off" only a lawyer will know what to do.

    I am discovering that it seems to be common practice for the State Police in these parts to search without warrants all together. Two of our neighbors have had this happen. One neighbor was treated very similarly to us, more than once, with much more destruction. At one point their house was even burned to the ground AFTER the police searched it. Same cops involved... They got out of all their legal troubles, but then recieved a forfeiture notice! The creeps are trying to take their farm. And because they are not in any legal trouble and they don't have alot of money, they have no lawyer. My other neighbor had his house searched while he was not home also. He has no idea what they were looking for and that is not the first time they have been there while he was away. We know, we can see everybody who comes in and out of there. The police WILL NOT TELL HIM what they wanted! He's asked 3 different times. Something is looking mighty fishy here. We are told that unless they actually charge someone with what they found at our place, that we can not fight the warrant. My old man is about to DEMAND that they either charge him or throw out the paperwork! We have contacted the ACLU (good luck!) and I'm toying with the idea of an official complaint, even tho friends in high places say don't, it will just piss them off. Well, I don't want MY house burnt down! But I'm on a mission at this point. Possibly I should be looking for more folks in this county who have had similar trouble. These cops are out of control. The only thing that happens to them when (not if) they get in trouble is that hey get transferred out of county for a while. Then when things get calmed down (or they cause too much trouble somewhere else) they get transferred back. Any suggestions?

    I don't know much about how things are in West Virginia, since I've never been there, but here in Oregon most of the news media has at least one reporter who likes to get ahold of cases like this to do an expose' of police misconduct. A little publicity from one of them might help, if you can find a reporter who is willing to take them on. A reporter at least might be able to get some answers for you, if you can find one who would work with you.

    the prime directive, learned in the sixties, is "keep your head low". While I understand your righteous indignation, you are about to violate this directive at greater risk to yourself than anyone else including the "authorities".

    Media exposure seems to be your best weapon... anything to clue in the average slothful couch potato that this can happen to him.

    My sympathy and condolences on the loss of common sense and liberty. It's probably going to take some large scale civil unrest to get any sort of attention- albeit negative.

    So on another note, it seems that they knew that you were growing. As evidenced by the fact that they didn't look for your stash, only your plants. Now a question that I have is who is to blame? Probably not the cops who acted on the rat's tip, at least not quite as much as the rat anyway. Now I'm not saying don't blame the cops..by all means heap a fair amount of blame on those tax wasting bstrds. But my point is, who ratted you out?
    Now I have to wonder what you and your 2 neighboors have in common? It's very possible that the three of you all know the same rat. I would look to some of your sons "friends", or enemies first.
    You may or may not care "who dunnit", but it sure has me curious.

    Far as we can tell, these kids who "ratted", and we did find out right away who they were, don't even know us, They just know hippys live here, and they don't really know my son either. They had heard some rumor or another about him, untrue, started by the state police by the way, (the rumor mill around here is HORRIBLE!!!) and thought they would be "smart" and try to get someone in trouble to try to get themselves off. Lots easier ratting on someone you don't know than your buddies. Anyhow, there has been alot of thief activity in the area for a while and we suspect that they may have come here at some point during the summer when we were camping and snooped around. Or it just was coincidence. And just as a side note, these particular state cops have had it out for us for many years, because we ARE hippys and don't try to hide it. Plus this farm has a history(before us), and the cop in charge knows it... (his dad actually blackmailed the previous owner, they lived right down the road---nasty other story) Years ago his family thought they should own it for a number of evil and selfish reasons, and they had a COW when they found out I was moving in... Plus I have managed to get him in trouble with his superior officer a couple times, and get him laughed at in a court hearing once. So I'm sure it's got something to do with getting even. He's a weazle. Also there is a plan for an interstate around here somewhere close by which would make all these lovely large tracts of land very valuable... We are looking into this angle. One of the money people around here is buying a bunch of large tracts of land along this line of propertys... Conspiracy? Probably. The shitty cop told some of the other neighbors they were messing with that before they were done with them, their place would be a state park... Yea, media. Just trying to figure out how to go about this right. We have the county commissioner on our side....................

    Suddenly this new highway is all in the news, strange coincidence, and they say it will never happen in our lifetimes. Well, OK.

    We have spokien with 4 lawyers. All say basically the same things. Because the warrant was so screwed up, good chance they will never persue it. If they do, even better chance it will be thrown out. One lawyer even laughed out loud when he read it. He said it was the best example of "stupid fucking police ineptitude" he's ever seen. And he felt that because the police around here have made such a habit of screwing up, that they may not even want this to come to light...
    But ALL the lawyers have some things in common. Seems you would have a hard time finding one who didn't very much dislike the state police. They all know what the "pigs" are all about, and do not trust them. Maybe that's why they became lawyers?
    They all also say that the police are behaving this way because they feel that most folks are too poor here to hire a lawyer and take them to court, and the cost of a lawsuit would probably not make any sense as far as what a person might win if they did win a lawsuit, so they can just behave any way they like. They also all say that it is better to leave sleeping dogs lie, because if you make waves they will make it even harder for you. Not too good of odds for the underdog. So alternative forms of fighting them are it. News letters, website perhaps, media attention. I have some plans. They hate me anyhow.

    Their latest fiascos include a couple shootings of folks they were trying to arrest, "under investigation" they say. One guy died. Maybe the police will just hang themselves eventually. One thing we are finding out here tho. NEVER call 9-11 for anything, unless someone is dying of a heart attack on your kitchen floor... That's how these guys ended up being shot.

    Someone I know REAL WELL called 9-11 in a mental health crisis, trying to get a mental health warrant, and the police lied to them about what they would do when they got there and ended up calling in a fucking swat team with choppers and all, tried to evacuate the entire neighborhood, and pointed all their fucking high powered rifles in everyones faces, including mine, when they drove up the road to try to leave. It was a MIRACLE that guy did not end up dead too, or someone else...

    If someone has a heart attack on your kitchen floor, you are not supposed to dial 911. You are supposed to drag him to the sidewalk and then call 911. Don't forget about the garden...never call 911 if you have a garden!
