So iam in high school and just a normal mundane day and i hear that my friend gets sent down to the office and gets completely searched, like shoes, pockets, bookbags, locker etc. (just not cavity search lol). So i am like "what the fuck" they have no legal means to do this.so i was talking to them and apparently my friend was just friendly chatting with a kid who in the past got busted with grass on school, so that is their only means of a search, because he was talking to a kid who in the past got busted. Now my friend defintely looks like the smoker type, and its pretty obvious that he does smoke (e.g. long hair, hemp bracelts etc.) but what the school did seems pretty illegal. Agree?
Not illegal. There's plenty of precendent. All the school officials need is suspicion and they can search you, your bag, you locker (i think even your car if it's on school property) for weapons, pornography, drugs, paraphenalia, ect. Not fair, but also not illegal.
If you are a minor they have to allow a parent/lawyer to be present for any search if you requset it, its a nice way to buy some time.
yep. school doesn't need probable cause to search, just "reasonable suspicion". good reason not to bring smoke to school.
They can search your locker and anything in it, but they have to have parental consent to search you or your car.
It is in Maryland because I know they searched a kids car without permission, and all the evidence was lost.

They're allowed to search your shit and locker but have no right to check you or your pockets. If they had a cop there and had probable cause then this wouldn't apply.
there was no cop when i was searched and unless being late to an assembly is probable cause then they searched me illegally

Locker is school property so they can search that or jack off into it or whatever they want. Everything else they need permission for... exept cavity search they can also assrape all they want

yeah man, the minute you pull your car up into the school parking lot you forgo many of your usual rights. As long as your property is on school premises, it can be searched. That includes cars. Your person can be searched, your personal artifacts can be searched, and of course your locker can be searched. This is done in the interest of "protecting" students. that way, say, if there was a bomb threat, they don't need to get warrants and such to search the school and find it. just don't bring weed to school. if you do, take it in small amounts, and tell NO ONE. even that isn't a guarantee, cuz if the school hears something about someone else, that could mean dogs. when i was in middle school, this kid sold smarties. yeah, the candy. we crushed some of them up, and just left the white powder on the floor. the school principal freaked out and called the police and they brought drug sniffing dogs and searched the entire school.
well, seeing as being in a school is a privelege, they have every right to control your life while you are attending. you get an education and they get control of the environment
you have to go to school, one form or another... also they have just as many rights to control your life as the public library does when you go to check out a book
