The problem with those two harmful acts is that it is inflicted on innocent people. If I had a toke four years ago, how is that any worse than the guy who drinks a couple of beers every Saturday. I had 9 alcoholic drinks last year, and one this year so far. So you equate my two tokes in five years with rape and murder?
