Judge Smacks Down ICE and Orders NYC Street Vendors Released

    excerpt:

Manhattan District Judge Vernon S. Broderick noted that Immigration and Customs Enforcement failed to provide a warrant or probable cause to arrest Ndoye, in particular, writing, “Absent such procedures, the agency will be free to either engage in preplanned decisions to unlawfully detain individuals and then come up with post hoc rationalizations, or merely randomly stage ‘encounters’ without the intent to unlawfully detain individuals and then create post hoc rationalizations for these unlawful detentions.”

It's an accurate description of Trump. Arrest and detain now. Fabricate post hoc excuses later.

Judge Smacks Down ICE and Orders NYC Street Vendors Released

    excerpt:

"Federal judges have ordered the release of at least three of 10 West African immigrants who were swarmed by federal agents in multiple immigration raids in October and November on New York City’s Canal Street, a popular site for street vendors.

Serigne Diop, Mamdou Ndoye, and Abdou Tall will be released, while the other seven men remain in ICE detention centers in Louisiana and New Jersey."

Live updates: Trump says he’s enacted a 10% global tariff by executive order

    excerpt:

"Furious about the defeat, Trump said he will impose a global 10% tariff as an alternative while pressing his trade policies by other means. The new tariffs would come under a law that restricts them to 150 days."

Trump gives grudging praise to liberal trio who helped sink his tariffs

    excerpt:

"The United States may be required to refund billions of dollars to importers who paid the IEEPA tariffs, even though some importers may have already passed on costs to consumers or others," Kavanaugh wrote. "As was acknowledged at oral argument, the refund process is likely to be a ‘mess.’"

At least Kavanaugh is acknowledging that tariff costs are passed on to consumers.

Trump doesn't admit it and instead talks like it's free money coming in from other countries.

Trump gives grudging praise to liberal trio who helped sink his tariffs

    excerpt:

"Other alternatives will now be used to replace the ones that the court incorrectly rejected," Trump said. "We have alternatives. Great alternatives. Could be more money. We'll take in more money, and we'll be a lot stronger for it. We're taking in hundreds of billions of dollars. We'll continue to do so."

It's hundreds of billions of dollars of taxes on U.S. businesses that are eventually passed on to U.S. consumers.

Judge Smacks Down ICE and Orders NYC Street Vendors Released

    excerpt:

The Department of Homeland Security insists that the arrests were justified.

“Despite activist judges, President Trump and Secretary (Kristi) Noem will continue fighting for the arrest, detention, and removal of criminal illegal aliens who have no right to terrorize our communities,” DHS spokesperson Tricia McLaughlin said in a statement.

    They are street food vendors.

It's the opposite of what the Trump administration says. The people of NY are trying to keep their street vendors and other people safe from Trump's violent agents.

    excerpt:

On the White House Facebook profile in the aftemath, the president pledged an executive order to apply a "10% GLOBAL TARIFF" under Section 122, "over and above our normal TARIFFS already being charged."

Section 122 tariffs Miller believed would be challenged in court almost immediately if excercised, he said, and were the court to keep those tariffs from taking effect, "we will see a massive surge of imports into the USA in the short term."

    excerpt:

"Unlawful use of emergency power: The IEEPA does not grant the President authority to unilaterally impose tariffs.

Strike down of 145% duties: The ruling invalidates a core administration policy that saw duties on some foreign goods soar as high as 145%.

Major potential economic consequences: The decision leaves the administration’s trade framework in "tatters" and creates immediate legal questions regarding the refund of billions of dollars in already-collected duties.

Winners, losers: While broadly seen as a "win" for consumers and small businesses, domestic manufacturers may lose the competitive advantage tariffs provided."

In 2025 Trump kept the heat on China with 145% tariffs hoping it would cave in to him. China didn't.

The warehouses on the west coast of the U.S. were going empty. Store shelves would have been next. Trump conceded.

Later in 2025, Trump met publicly with Xi of China. Trump looked like a dog with its tail between its legs.

Xi didn't rub it in. He kept a consistent and polite posture of fending off Trump's trade tactics.

Trump has been using Section 232 of the Trade Expansion Act of 1962 to impose steel and aluminum tariffs.

The U.S. Supreme Court this week didn't strike down Trump's use of Section 232.

    https://www.congress.gov/crs-product/IF13006

    excerpt:

"Article I, Section 8 of the U.S. Constitution gives Congress power to impose duties and regulate foreign commerce. Congress has delegated some of these authorities to the President through statutes. Section 232 of the Trade Expansion Act of 1962, as amended (19 U.S.C. §1862) allows the President to impose restrictions on goods imports or enter into negotiations with trading partners if the U.S. Secretary of Commerce determines, following an investigation, that the quantity or other circumstance of those imports "threaten to impair" U.S. national security."

Trump's emergency tariffs have been in effect since April 5, 2025.

It's ten and a half months worth of tariffs that businesses have paid to the government that they now have a legal basis to claim a refund.

Jean Galbraith on the Supreme Court’s Rejection of Trump’s Emergency Tariffs

    excerpt:

"The Supreme Court has now held that IEEPA’s vaguely worded power to regulate imports does not include the power to impose tariffs. Of the six justices in the majority, three were appointed by Republican Presidents (including two by President Trump himself) and three were appointed by Democratic Presidents.

This is a major rebuke of President Trump’s efforts to push legal boundaries. Its direct impact is substantial. President Trump has unleashed considerable disruption on world affairs in the last year with his sweeping and often arbitrary tariffs. Any new tariffs will now have to be done consistent with the constraints in the tariff-specific statutes. He thus has fewer tools with which to wreak havoc on world stability – unless he can go to Congress and persuade them to pass a law that clearly gives him this power. More generally, the Supreme Court’s decision is an important reminder that the powers of the President are not limitless, but rather subject to law."

Trump says he signed a 10% global tariff after Supreme Court decision

    excerpt:

Newsom said in his own statement that the Trump administration should immediately issue refund checks, with interest, to American families and businesses.

"Time to pay the piper, Donald. These tariffs were nothing more than an illegal cash grab that drove up prices and hurt working families, so you could wreck longstanding alliances and extort them," Newsom said in the statement.

"Every dollar unlawfully taken must be refunded immediately — with interest. Cough up!" Newsom continued.

He raised the worldwide tariff to 15% now.
But that's not legal under any statute.
But it will probably be allowed until it works it way thru the courts.

If Trump can just break all these laws, aren't there consequences? Why doesn't a judge just lock him up like any other criminal?

Then let him go to court to try and get out of jail, drag the drama out to the end of his term if he survives in prison!

He can claim executive privy or whatever, but let him rot until it goes all the way thru the system.

In any case keep him far from THE BUTTON! As well as any other Armageddon freaks salivating over another Mideast war.

I wish people would stop comparing Trump to Satan.
Sure, he's evil...but not as evil as Trump.
