    In Immunity Case, Trump Can Lose in Ways That Amount to a Win

    "In a concurring opinion, two of Mr. Trump’s appointees — Justice Brett M. Kavanaugh, joined by Justice Neil M. Gorsuch — summarized the court’s mixed message this way: “The court today unanimously concludes that a president does not possess absolute immunity from a state criminal subpoena, but also unanimously agrees that this case should be remanded to the district court, where the president may raise constitutional and legal objections to the subpoena as appropriate.”

    That turned out to be a good way to lose. The case kicked around for more than six months before returning to the Supreme Court in February 2021, when the justices issued a final ruling against Mr. Trump — months after the election.

    In the case it will hear on Thursday, the Supreme Court could easily follow that approach, ruling against Mr. Trump but ordering lower courts to address other issues. Indeed, if the court is inclined to let judicial history repeat itself, the sentence from Justice Kavanaugh’s 2020 concurrence would need only a very light edit."

    Sure it does. Trump can be expected to continue to visit deep-fried chicken restaurants in NY when he's on break from his criminal trial and do photo-ops with African-American pairs who look like they are auditioning to be the next Diamond and Silk.

    Donald Trump again is trying to bend the Supreme Court and justice system to his will

    John Eastman was a clerk for Clarence Thomas.

    Eastman has been indicted in GA and AZ for trying to steal the 2020 election from Biden.

    Trump claims immunity from everything he did as president.

    That raises the question as to why the Constitution bothered to provide a way for Congress to remove a president from office for high crimes and misdemeanors. If a president is immune from all of that, why bother establishing a way for him to be removed from office for it.

    It also raises the question of why Ford bothered to pardon Nixon after the Watergate scandal.

    Barr was directly on the receiving end of Trump's desire to steal Biden's win without evidence that the election was fraudulent. Trump wanted Barr to make false statements to the country that the election was stolen from Trump.

    That sounds like an abuse of power, but Barr says he is still skeptical. He's willing to give Trump the benefit of his doubt and support him all over again.

    Even Mike Pence didn't go that far.
