Trump is furious that Smith is making an effort to cut off his escape paths in criminal court, such as blaming his behavior on conspiracy narratives like the one about election worker Ruby Freeman. Another is blaming his riot on Pelosi supposedly not accepting 10,000 troops from him (that Chairman Mark Milley testified Trump never ordered). She didn't have the authority to direct such troops like Trump did but who was derelict in his duty during the riot.
The conservative Supreme Court could try to liberally claim that a trial should happen first and that a president should be convicted of an insurrection as a prerequisite before he can be removed from the ballot. But the 14th Amendment states no such requirement. It could be extremely conservative and narrow and claim that Trump is exempt from disqualification because the 14th Amendment refers to the word 'support' the Constitution, but Trump took an oath of office that said he must 'preserve, protect, and defend' the Constitution, not necessarily 'support' it (Trump's team is already promoting this claim). Maybe the Supreme Court can formulate such interpretations, make them look palatable to legal experts and the general public, and keep Trump on the ballot. It also has the option of not hearing the case at all, although that would seem unusual considering the national significance of the issue and the lack of legal precedent.

I don't doubt that the "supreme " court would rule in trump's favor--being constitutionally correct is no longer the aim of this court. After all, the three trump appointees said / lied when they "affirmed " that abortion was settled law. The promptly voted to overturn it. There now appears to be at least three liars, two crooks and a few who make attempts to rule correctly. Again and still: Trump has all but ruined this country in ways that will take a generation or two to correct. IF ---AND THAT'S A BIG IF--his damage is correctable .Everything he touches or speaks about clearly shows he's a narcissistic psychopath and also clearly belongs in prison.
