    Another indicator of Trump's concern is his spending of $3 million up-front from his Save America PAC to attorney Kise to defend him against the DOJ.

    Trump won twice. He got his pick for special master, and Judge Cannon didn't lift the injunction that prevents the DOJ from using the documents in the criminal case.

    The DOJ will likely appeal to the 11th Circuit.

    About half the active members on the 11th Circuit are Trump appointees.

    If Trump loses to the DOJ on the issue of using the seized documents for the criminal case, he could potentially appeal to the Supreme Court. A third of its bench was appointed by Trump.

    Outside the issue of how many days for the special master review (which Trump essentially won, 75 instead of 90), Trump also won initially because he was able to obtain a special master review in the first place.

    Flippantly, part of the rationale for a special master review stems from the fact that Trump had seemingly mishandled the documents by mixing them with his personal property, some of which was seized by the FBI.

    Trump's mishandling has given him the benefit of using a delay tactic on a criminal investigation that alleges he mishandled documents.
