If he had taken presidential action against the riot, he could have had at least some argument that he tried to stop it that he could have used in court when faced with civil and criminal cases. The riot he helped start was outside the scope of his presidential powers, but he did essentially nothing within his presidential powers to stop it. It puts him in a bad legal position.

I just saw an article which told the federal government has a provision in the Constitution in the Fourteenth Amendment which gives it power to go after states which restrict voting rights. Section 2 of the 14th specifically says states cannot abridge voter rights. The word could be understood to mean "encumber" or "restrict" voter rights. Under this constitutional authority, the federal government --Congress-- can reduce that state's representatives by 10% and also reduce their electoral college electors by 10% similarly. I'm thinking that would be a nice remedy for states like Texas.
