    Judge Demands Trump Org Quit Stalling on Turning Over Evidence

    "New York AG Letitia James and her investigators have been locked in a fierce legal battle with the Trump Organization. Former President Donald Trump’s son, Eric, refused to testify until the judge intervened—only to have the executive plead the Fifth nearly 500 times. The company refused to turn over most records until last September, when the judge again intervened to force compliance.

    When Trump and his two other adult kids, Don Jr. and Ivanka, refused to show up for depositions in January, the judge again stepped in to order them to sit down and answer questions. (That last decision is now on appeal.)

    At issue now is that HaystackID, the third-party firm the Trump Organization had to retain to help it sort through records, is supposed to be a neutral player identifying how close investigators are at getting what they’ve always needed. But those reports haven’t been helpful.

    When the judge asked to hear directly from HaystackID’s top forensics officer, John Wilson, the judge’s law clerk let her disappointment be known.

    “I took a look at the reports you've provided and they seemed very barebones. The reports you gave don’t offer much information, quite frankly,” said the judge’s principal law clerk, Allison R. Greenfield."

    Given that so many of the Trump Organization’s financial shenanigans stretch back six years or more—potentially making them too old to prosecute—the AG’s office has managed to freeze time on New York’s statute of limitations by entering into a “tolling agreement” with the Trump Organization. But that signed deal expires at the end of April, so investigators want to search through all the evidence long before then.

    "Days, months, start to add up and become significant," Assistant Attorney General Austin Thompson said in court, citing what he called “extreme circumstances” entirely caused by the former president’s company.

    The AG’s investigation increasingly looks like the last chance for New York law enforcement to hold the former president and his company accountable, given that the Manhattan District Attorney’s parallel criminal investigation appears to be fizzling out."

    Alex Jones spoke at Trump's pre-riot rally on the Ellipse. He said met with the Jan. 6 committee but took the Fifth.

    He cited an unspecified medical condition a couple of times to avoid appearing at a deposition related to the Sandy Hook case.

    White House records turned over to House show 7-hour gap in Trump phone log on Jan. 6

    "Internal White House records from the day of the attack on the U.S. Capitol that were turned over to the House select committee show a gap in President Donald Trump's phone logs of seven hours and 37 minutes, including the period when the building was being violently assaulted, according to documents obtained by CBS News' chief election & campaign correspondent Robert Costa and The Washington Post's associate editor Bob Woodward.

    The lack of an official White House notation of any calls placed to or by Trump for 457 minutes — from 11:17 a.m. to 6:54 p.m. — on Jan. 6, 2021 means there is no record of the calls made by Trump as his supporters descended on the U.S. Capitol, battled overwhelmed police and forcibly entered the building, prompting lawmakers and Vice President Mike Pence to flee for safety.

    The 11 pages of records — which consist of the president's official daily diary and the White House switchboard call log — were turned over by the National Archives earlier this year to the House select committee investigating the Jan. 6 attack.

    The records show that Trump was active on the phone for part of the day, documenting conversations that he had with at least eight people in the morning and 11 people that evening. The gap also stands in stark contrast to the extensive public reporting about phone conversations he had with allies during the attack."

    Various calls Trump had with people at the Capitol don't show up on the official White House log for about 7 hours mid-day on the day of the riot at the Capitol.

    Trump called Mike Pence in the late morning before he started his speech at the Stop the Steal event at the Ellipse. That call doesn't show up in the logs.

    Trump mistakenly called Mike Lee around 2 pm on Jan. 6 trying to reach Tommy Tuberville.

    McCarthy spoke with Trump by phone during the riot and said that the windows of his office were being smashed by rioters. McCarthy was upset and the phone call was profanity-laced.

    Audio recording of Giuliani's intended for Tommy Tuberville that he mis-dialed. Another member received the call and published it.

    Giuliani was trying to invoke election objections to as many as ten states during the evening of January 6 after the riot settled down. He needed the help of the newly sworn-in U.S. senator Tuberville to vote, along with a needed House member, for each state to invoke an objection to the result of the election of a state.

    Arizona was one of the states that was contested on Jan. 6. It was invoked by one senator and one House member. After each chamber debated it, in accordance with the Electoral Count Act of 1887, the Senate later voted 93-6 to not pursue the objection.

    To send an electoral slate of a state back to the state for which an objection was raised, a majority vote by both the Senate and House is needed for each objected state after a debate. That is nearly impossible for a situation like Trump was contesting for which there was no significant fraud or any other significant issue that would warrant such an extreme move by Congress.

    Giuliani wanted an objection of ten states and a debate in the Senate and House that would be required for each objection. It could have run the delay of Biden's certification into the evening of January 7.

    Giuliani said he wanted to use this delay tactic so that state legislatures in states Trump lost could present evidence to Congress that the election was rigged, which would supposedly convince members of Congress to change their minds and object successfully to the results of a number of states.

    It shows the desperation of Trump and Giuliani.
