    "Recently, MSNBC anchor Rachel Maddow unearthed fake certificates of ascertainment submitted by the unrecognized electors in five states, noting that they “all match exactly” and appeared to be part of a coordinated effort. These rival slates, it’s since been revealed, were used as proof by Team Trump to convince Vice President Mike Pence he could reject Biden’s victory.

    Giuliani oversaw the effort, as the Post reported, and was assisted by a host of other Trump allies, advisers, and officials. One of the individuals who helped the Trump lawyer with outlining the strategy was Bobb, a host on far-right cable channel One America News."

    This appears to be the the rationale for Giuliani and others to create alternate fake slates of electors for the swing states that Trump lost.

    Trump could claim that a (Giuliani-manufactured) conflict existed in states that were submitting two conflicting slates of electors for the same state, which would give Pence a reason to not certify the Electoral College votes.

    The upshot of that scheme would be to somehow retroactively change the slate of electors in enough states Trump lost to a slate that was for him, making him the winner with more than 270 electoral votes.

    The other alternative would be to dismiss the popular vote-based Electoral College votes altogether (because of the conflicting electoral slates) and send the entire election to state legislatures where each state has one electoral vote. Considering that Republicans control a majority of state legislatures in the country, with one vote each, Trump would have a chance of winning the 2020 election.

    I still think he had something to do with knocking off Epstein to make sure he didn't talk or take a plea agreement. Rudy was well connected with that federal jail and knew that Barr was moving Epstein from the New York facility to the federal one. Rudy was an insider in the fed criminal justice machine in NY for a long time.

    The Electoral Count Act of 1887 is showing its age – here's how to help Congress certify a presidential election with more certainty

    "For instance, some Republican state legislators in 2020 – encouraged by Trump – suggested they could appoint their own electors well after Election Day if they were dissatisfied with the results certified by the state’s election officials.

    Some cited a provision in federal law that if the state “failed to make a choice” for choosing presidential electors on Election Day, the state legislature could appoint them later. But this provision was designed for states that required majority winners in presidential elections and might hold a runoff after Election Day if no candidate received a majority.

    Congress could repeal this “failed to make a choice” provision and insist that Election Day is Election Day, with no opportunity under the statute to second-guess the results. But there are complications that arise with even a simple reform like this.

    A state might suffer a terrorist attack on Election Day or be hit by a hurricane the night before. Should the state have a chance to hold its election a week or two later? And if so, how does Congress define the circumstances when a state could hold a later election? "

    Congress may change this arcane law to avoid another Jan. 6

    "The Electoral Count Act came as a reaction to the presidential election of 1876, which saw Democrat Samuel Tilden win the popular vote but ultimately lose the presidency to Republican Rutherford B. Hayes because of contested election results coming from three Southern states under the control of Reconstruction governments: Florida, South Carolina and Louisiana.

    The three states each sent in multiple competing electoral returns, and Congress had no rules in place to deal with such a scenario.

    So, it created an ad hoc commission to decide the presidency, which ended up giving the states' returns, and with them the presidency, to Hayes.

    Democrats at the time were furious over the decision and only accepted it in a deal known as the Compromise of 1877, which stipulated that Republicans agreed to end Reconstruction and withdraw federal troops from former Confederate states.

    A decade later, Congress passed the Electoral Count Act into law to avoid similar situations in the future, but "the crafters of this law unfortunately did a terrible job," says Rebecca Green, the co-director of the Election Law Program at William & Mary Law School.

    "Some of the processes just don't make sense in the modern world," she said.

    The legislation is "extraordinarily complex" and "far from the model of statutory drafting," according to an analysis by the National Task Force on Election Crises (of which Green is a member), but the law does create a framework and timeline for when states need to have their election results finalized."
