    'Outrageous': Judge Lays Into Trump-Loving Deputy Who Wore 'Sheriff' Patch On Jan. 6

    "Ronald Colton McAbee, known to online sleuths investigating the Jan. 6 attack as #ThreePercentSheriff because of the insignia he wore representing the far-right cause, was arrested in mid-August. A federal magistrate judge in Tennessee ordered McAbee released with conditions, including to “refrain from using any social media or other websites related to insurrection activity.” But federal prosecutors filed an emergency appeal of the judge’s ruling, and the matter was reviewed during a hearing before U.S. District Judge Emmet Sullivan on Wednesday.

    Sullivan called McAbee’s decision to wear a “Sheriff” patch while he attempted to storm Congress on Jan. 6 “outrageous” and said videos apparently showing McAbee attacking officers were “very disturbing.” While McAbee’s defense attorney maintained that McAbee was offering assistance to one officer and only pushed another officer after the officer pushed him, Sullivan said it “appears clearly to this court” that the video showed McAbee pulling an officer into the violent mob."

    A lawyer named Eastman wanted Pence to refuse to certify the electoral votes to buy more time to argue that votes (mostly Democratic) should be thrown out based on the approach they were cast (which he didn't like).

    Pence was seen by Eastman as a judge to determine himself which votes should be thrown out based on how they were cast.

It begins by delineating various ways in which “state election laws were altered or dispensed with altogether in key swing states and/or cities and counties.” In essence, he’s arguing that Pence would be warranted in throwing out the results in some states not because people cast illegal votes but because states allowed people to vote in ways they shouldn’t have. It’s an argument for throwing out the demonstrated will of the people based on the way they were told to express that will. (A court in Pennsylvania, hearing such a claim before Jan. 6, had rejected the idea that votes cast using a process that shouldn’t have been authorized should stand, calling a rejection of them an “extreme and untenable” remedy.)

    Even here, though, Eastman oversteps. For example, why should bringing “portable ‘polling places’ targeted to heavily democrat” areas be considered a rationale for rejecting the results of those votes? Or: “federal court reduced Arizona’s 29-day-before-election registration requirement”? Because a federal court changed a rule, no votes from Arizona should count? It’s quite simply a rejection of the will of the voters for no reason other than that Eastman didn’t like how they voted."

    In a letter to the court on Friday, the group’s lawyer, Jack Wilenchik, suggested Cyber Ninjas would turn over some documents, if it felt like it.

    “I also emphasize that, while CNI [Cyber Ninjas, Inc.] intends to produce documents out of goodwill and its commitment to transparency, by sending this communication CNI does not concede the existence or scope of any involuntary legal obligation to do so,” Wilenchik’s letter read.

    Wilenchick objected to the court order on two grounds: that Cyber Ninjas should not be subject to public records laws, and that Cyber Ninjas is too busy to release court-ordered records (which a judge ordered Cyber Ninjas to preserve in August)."

    From its outset, the group has displayed hard partisan leanings, with members of the “audit” team promoting voter fraud conspiracy theories and claiming to check ballots for bamboo fibers, which they claimed would indicate that a ballot had been fraudulently shipped from China. Backers of the audit, like former Overstock CEO Patrick Byrne, have appeared to preview the audit’s findings even before the report’s release, with Byrne stating on Telegram last week that he thought the report would reveal that Donald Trump actually won Maricopa County. (Republican officials in Arizona and Maricopa County have verified President Joe Biden’s victory there.) Logan, meanwhile, has appeared in a voter fraud conspiracy movie, which was based on a book Byrne wrote and included interviews filmed at the audit site.

    And those were Cyber Ninjas’ public statements. Behind the scenes, Logan was an even more active participant in pro-Trump conspiracy theories, promoting them on Twitter in late 2020. A new report by the Arizona Republic revealed that Logan collaborated on voter fraud theories in late 2020 with Trump lawyer Sidney Powell and former Trump National Security Adviser Michael Flynn. Logan helped Powell write subpoenas in a bid to gain access to voting machines, the Republic reported."

    "Former President Donald Trump may have offered to help pay for Arizona Senate election audit that supporters hope will reverse his election loss, according to newly released records.

    In an April text exchange with audit spokesman Randy Pullen, Trump campaign official and former Arizona state treasurer Jeff DeWit offered to send $175,000 to the Guardian Defense Fund, a dark-money fund run by Rep. Mark Finchem, R-Oro Valley, where Pullen serves as treasurer. A dark-money fund is not required to disclose its funders. Finchem is also running for secretary of state.

    DeWit later asked about a second nonprofit that contributed money to the audit, Fund the Audit by The America Project.

    “So they are ok to donate to? Trump asking,” he texted Pullen on April 28.

    It’s unclear if Trump’s money eventually made it to the Senate’s election audit. The Senate’s contractor, Cyber Ninjas, announced in late July that it raised more than $5.6 million from five different nonprofit organizations, but didn’t share the original donors. The Arizona Capitol Times has also not independently confirmed whether Trump or any of his affiliates contributed money to the campaign."

    Bennett on several occasions mentioned how he did not like the tone of the account and thought it was unprofessional. He said the same to Hunnicutt in a May exchange.

    “They’re running it like a bunch of third grade bullies in my opinion,” he wrote, adding that they had ties to Logan, the Cyber Ninjas CEO who previously boasted about how he thought the election was stolen from Trump. “These guys are from FundTheAudit.com I think.”

    The released records don’t include any communication between senators, who maintain that their conversations are protected by legislative privilege."
