This is the problem I have with originality, like Scalia, and Barrett. If it was up to them, women, and minorities would not be allowed to vote, and people would not be allowed to get drunk.

The big problem with originality is that it's a fantasy. We can only infer from the vantage point of a couple of centuries what those guys were thinking, and I suspect in many cases the didn't have any intent at all but were kicking the ball over to others to figure out what it meant. Chief Justice John Marshall, who was around at the time, said we have to keep in mind that this is a constitution meant to last and must therefore be interpreted flexibly to meet changing conditions. McCulloch v. Maryland. Otherwise, there go our Air Force and nuclear arsenal--not to mention the Space Force!

With Republican style originality we lose all the famous precedent cases under the Necessary & Proper Clause and the Commerce Clause. Are you aware that a good many of OUR Forest Service Fire Fighters are Native Americans? Are you aware that America has many lawyers who come from Native families? Did you know that the University of Tulsa and University of Denver have law programs which specialized in Bureau Of Indian Affairs law?
