    It's a matter of judgment. That's why we have judges. They are the "whos" who interpret the speech as protected or non-protected. E.g.,he courts have decided that obscenity isn't protected speech. What is obscene? That's a notoriously difficult thing to define, but the courts have defined it and outlawed it. Currently, the courts use the 3-pronged Miller test:
    • Whether "the average person, applying contemporary community standards, would find that the work , taken as a whole, appeals to the prurient interest,
    • Whether the work depicts or describes, in a patently offensive way, sexual conduct or excretory functions specifically defined by applicable state law,
    • Whether the work, taken as a whole, lacks serious literary, artistic, political or scientific value.
    As for "fighting words", the leading case Chaplinsky v. N.H. (1942) defined them as words that tend to incite an immediate breach of the peace." In Street v. N.Y (1969) the court held that mere offensiveness does not qualify as "fighting words". Accord, Cohen v. Cal. (1971); Snyder v. Phelps, 2011. In a world where conflicting interests need to be protected and no rights are absolute. It's a matter of the offender's intent and the reasonableness and commonality of the victim's sensibilities.

    Trump, of course, is in a special category: a public figure, meaning he has less protection. If I went to a Trump rally and called them all-out racists, I think that would qualify as fighting words (like your girlfriend in the California bar), and it would be appropriate for the bouncers to escort me to the door to avoid having the MAGA crowd mess up the place with my blood. But your hypothetical about triggering Trump supporters to take a bomb to a Warren rally, that probably wouldn't qualify as fighting words. Fighting words are of the kind calculated to trigger immediate violent, reflexive reaction.(e.g., Yer mudder is a whore. )

    I dont really agree that society has a casual attitude towards it but I'll pretend for the sake of conversation. How would you go about changing societal attitudes?

    I kind of had an idea that his health wouldnt hold up through this campaign, the man campaigns like a machine but of course he isnt a machine, he's a 78 year old man

    This is one of the reasons why I am opposed to people over seventy running for political office(this includes Biden, and trump). They are more susceptible to health problems.

  12. Maybe Bernie is too old, but he was the best candidate this country has seen for many years. Oh well, Liz Warren's not so shabby, either. So I will throw my support behind her instead.

    I just don't see it as being that difficult to defeat Donald Trump. He basically lost last time. Maybe if people get out to vote for once.

    Looks like we're trying to make history again, first woman president. Joe Biden, no thank you.

  15. Well, Bernie's technically an independent. Which, I don't think was the best choice for him, but he was making an effort to expand the two-party system. Had he been a lifelong Democrat, I bet everyone would be singing a different tune about him, singing his praises. He would have been the frontrunner with everyone's support thrown behind him.

    I'm not sure Iowa even has an indian reservation.

    An electoral system means you don't need 51% and he has a cult. Those that are not shot by a SEAL in a gun buyback (if one were to happen who knows) will vote again.

    I think she's 70 (bithday is in June), but your point is well-taken. There's a reason why the top tier in both parties are septuagenarians.

    l am 74 and I worked for 46 years and retired in 2012. I sure as hell would not want to be leader of anything at this point in my life. I think the presidency is best left to a younger person with the necessary energy. Clinton, Obama, and Carter come to mind.....Reagan, Trump lead the list of out of touch old Farts.
