Today during 8th period i walked down theh alls with a pass in my hand, and i was stopped by a teacher, known for his bully tactics in the school hallways...he took me, along with another kid, to the VPs office without telling us anything that had happened. he sat us down and went to the VPs room and talked to him for a while. they both came out and asked us where we were going and what class we had at the time, i told them the truth about how I had just walked down the hall to get a drink at the vending machine, and my teacher had told me i could get a drink, they asked the other kid his story and he told them. They went inside to talk again and came out, "You can go, Dan (me) you stay here". I knew this was going to happen, they took one look at me and my long hair and my tye dye shirt and they keep me, but another kid with a buzzcut and nice clothes on, they just let him go. The VP took me into his office and began questioning me about my mushroom necklace, and why i wear it. I told him it was a gift from a friend who went to costa rica, and that i just wear it because if I didn't she would be upset that i didnt. He told me it might attract some bad attention and I shouldn't wear it. He then became very questionable about if I had been to the bathroom 7th or 8th period, and I really hadn't been in the bathroom all day, so that's what I told him. he then told me I could leave and he would talk to my teacher later. Later on in the period they called me again, but my teacher confused the VP with another person and sent me to guidance instead. Once i went to guidance they told me they didn't call me down. A few minutes later after I had gotten back to class, the VP walks by and asks my teacher for me, he then looked at the clock and said he would call me down next period because we didn't have time to talk this period, so I went to my locker and found my friend and gave all my pot and salvia to him, I went to 9th period and awaited the call, but it never came. I then told my friend what had happened and he started laughing and was like "was it for the bathroom?" and i said "yeah" and he was like "haha, i was the one ripping in there" and i was like "whaaat, and your gonna let me take shit for it?" and he says "theres no way they can get you in trouble". My plan is, if they call me down to search or test me, I will threaten to call the ACLU and point out that it is a completely infraction of the 5th amendement. What do you guys think, do you think they have enough on me to search or test me? I honestly didn't smoke in there, and never would smoke in school, that's retarted, but i'm kind of afraid that I will end up getting in trouble over this....what do you think?

I'm canadian, so i don't really know what the 5th amendmant is. but i can say, that that is bullshit. good move with the dumping of the weed, to your friend though. Once, the drug dogs were out, and they sniffed out my bag. Havent smoekd weed in 3 weeks, and pots never been near my bag, but nevertheless, he barked. I had ritalin in there aswell, but it was only 2 pills, and stored away, where im 99.9% sure a dog would not smell it. I go to the principles office, and the VP told me to empty my bag. Legally, she couldn't, i had to do it for her, and if i dind't she woulda caled the cops. Without notifying my parents, let alone them being there, i emptied it, and with a big grin, said "wow, those dogs do sucha great job, at catching the real druggies". I am an honest guy, and when she asked "when was the last time you smoked pot", at first i wasa tad offended, and then i just said "about a month ago", so now the VP knows i smoke pot, but she knows i don't at school. A couple weeks ago, the drug dogs came, and the trainer (who isn't a cop), did a presentation, and i asked "are the dogs ever wrong", and he said "no, these dogs are 100% accurate, and never wrong..."

If I remember correctly, the fifth ammendment is Search and Seizures? They have not told you there reasons for questioning, obviously its just your appeareance, or theres something there not telling you. If I were you, I would let them search you locker, and get your pot out of your freinds, just in case they search his, and he ends up squealing. Leave it at home. All of it, because theres grounds for suspension or expulsion if they find one joint. For the next couple weeks just be extremely careful, if you need to bring pot, keep it in a pocket, and have esaily ditchable.

But, they do not have any reasons to search you it seems. If they try, say "absolutely" or "of course". It can make a diffrence, it shows a sign of inignancy. The way you present yourself in front of the vice preinciple can make the difference. Talk about how the way you dress gives you these unwanted stigmas, and that if you were principle your first order of buisness would be to clean up the school.

This happeed to me last week. I had 2 ounces, and a bong in my bag, while in the office. I played it excatly like that. When they asked if they could search my bag. I said absolutley. They were somewhat thrown off, and ended saying "its not nessecary."

But besides that, just be careful, and you should be perfectly fine.

 

I know a lot of schools get you or your parents to fill out papers giving them permission to search you whenever they want. Legally they can search your locker also. This is because YOU dont own the locker, they do.

 

I used to get this crap all the time in high school too. Mostlly just because I was very outspoken, long hair, the way I dressed etc..... My two cents would be to remove anything and everything from yourself, the lockers, your bags, etc... The argument that you're getting harrassed based on your appearance won't fly if they catch you with pot. As far as carrying the stuff to school anyway and then just giving them explicit permission to search your bag? Y'know, they could always say thanks and go ahead and do it.

i been searched at school alot too me and my friends. my friend recently got a 3 day suspension for a pinch of loose tobacco in his bag. my VP told me that if he had our school cop present then he could strip search me if he wanted to . I told him good luck with that cuz i aint strippin for no dudes. he said he wouldnt ever do that but he did search my bag and my shoes and even the inner linning of my hat(he was a cool dude and asked me where he got it and i saw him at a game the next week wiht one on ) lucky for me i had my cigs down my boxers but i rarely had weed at school. thats the way to do it. jsut dont have weed at school. if school is where u get it then either skip the rest of the day after u get it or get it after the final bell.

 

It's the 4th amendment that talks about search and seizure.

well we had a school cop who was always there. and if u wer ea big troublemaker( always skipping cussin out teachers and stuff) like us then u got to be a big name around skool. since he was a cop if someone mentioned my name involving cigs or weed they had probable cause to search me. i guess thats how it works. but i was always to quick for em

It's a fucked up situation really, most public schools have notices on the doors, usualy fairly small informing you that by enetering they can search all your shit etc, yet you are forced to go, and so essentially forced to give up that right.... As one of my vps said to me when I was still in school, 'Students have no rights' Stupid whore... as far as them asking you about your necklace and such, I'd just tell them it's none of their fucking business, though you might want to use different language, because at leats at the school I went to they will get a cop and write you a ticket... Yay for the U.S. public school system!

 

It's illegal for anyone under 18 to posses it, used to be just illegal to buy it but they changed it in most states, plus it's usualy not allowed on the school grounds regardless of your age...

 

You should have asked your VP why he felt the need to stereoype like that. The you should have asked him if he eats mushrooms and outlined the fact that they are very tasty (I am not talking about the magic ones). Damn narcs

Bill's right about the last part, as long as you don't get caught holding from now on you can't get in any trouble for the bathroom thing (unless of course someone lies and says they saw you do it. but thats just a fact of life. and then those people get their ass beat)

As far as possession and schools and shit:

Any cop can search anyone at anytime, for NO reason. I don't know about strip searchs, and I'm not sure if that applies to bags you're carrying, but I'm talking about patting you down and checking your pockets. Anyone, anytime, no reason.
The reasoning behind this is that of course any cop has the right to ask you questions for no reason. And they don't know if you're a criminal or not when they walk up to you. So if they start talking to you and you have a knife or gun in your pocket, you can quickly attack and kill them and they're pretty much fucked to do anything about it. SO, they therefore have the right to search anyone at anytime to make sure they aren't armed. And if they find drugs or anything else illegal that's not a weapon, well you're just fucked.

This might apply to bags you have too, and if it doesn't I'm sure the probable cause needed to check your bag is incredibly weak, like along the lines of "I didn't like the look in his eye," or "He wasn't answering my questions."

The answer of course being no.
Cops can push and throw you around for no good reason, but if you even touch them it's a crime. Cops aren't even in the top 10 of most lethal jobs, but they act like they get killed all the time. The LAPD has lost less than 10 officers to violence in the last 10 years. IN LA!!!!! More construction workers died in that time. No cop has ever been killed by a "Cop-Killer" bullet. But for whatever reason, probably cop shows on TV, Americans think violence against cops happens all the time and hold it as some sort of completely un-acceptable act that must be avoided using any means neccasary.

So bottom line, don't fuck with the cops.

But remember: cops cannot search your locked trunk or locked glove box without SERIOUS probable cause, or your permission. So if they ask your permission to search these areas, don't give it. If they search them anyways and bust you, and you make a big deal about not giving them permission and noting it on the arrest record, and you get an good attorney, you will probably get off scot free.
(unless they pulled you over cuz you were swerving all over the road or u commitied some general criminal act bad enough to give them probable cause)

But also remember: drug-dogs can search anything, anytime, anywhere, if they bark at it. No rules apply. If a drug dog is interested in something, the cops can search it on that alone. Man I'd love to kill those fuckin dogs.

So I don't know if school employees can search you, but they can get a cop to search you and your bag and the inside of your car for pretty much any reason.

And I'm pretty much sure that school officials or cops can search your locker for any reason or no reason, cuz it's school property.

Go to the NORML website and get edumacated. Cuz being a weedhead in jail fuckin sux...
