you dont pay a big fine?

i'm having issues with a big organisation at the moment. its a very long story and not very interesting, so i wont bore you with it.

the problem is, i have a massive fine as a result of some paperwork being lost by either the post office or them. i cant prove i'm right, but i cant pay the fine, and if i could i wouldnt want to coz i know i didnt do anything to deserve it.

so.....what happens if i cant appeal it, (which i dont think i can)?

does anyone know of anyone else who hasnt paid a fine? i have been threatened with balifs already. everything i own in the world doesnt add up to what the fine could potentially be, so even if they take my caravan and my van and everything but the clothes on my back i will still owe them money.

am i looking at jail or losing my caravan (e.g. my home) or what? i just wish i knew what i was getting myself in for.

if i was in the wrong i would borrow the money to pay the fine, but i know i dont deserve this fine so i object to paying it, but i dont want to lose everything so i dont know what to do.

thats why im wandering if anyone has any experience in this area or knows people who have been in a similar situation.

would appreciate any advice on this one.

    peace and love

I think it all depends what it is. I've got a list of outstanding parking fines as long as my arm and refuse to pay them. Not been caught yet despite the constant warnings although I have been close to getting clamped by bailiffs a couple of times.

You do not have to let a bailiff into your home and they can't enter when you are not there. You do have to be careful when opening your door though as they could put their foot in the door and that is all they need to walk in.

Bailiffs also cannot take tools of the trade and cannot take essential items like cookers etc.

They can however take a vehicle, so you might need to hide it or be able to 'prove 'that it belongs to someone else.

If you have any bills arriving in 'other' names, then use them to your advantage to prove you don't live there anymore.

Chances are you won't go to gaol.

the thing is, i live in my caravan but use my dads address for everything. i am not registered to this address so he can prove i dont live there. i am worried about them turning up there. i have been told they will be turning up on the 9th december if i havent paid by then. if he tells them i live in a caravan will they just go away?

i know they will have a job finding me, but i dont want to have to keep looking over my shoulder for them the whole time.

i am going to take the precaution of re-registering my van if it gets alot worse but i am still worried about losing the caravan. but if its my home then i guess it would count as an essential item.

grrrrr.........this is all very annoying. i am going to go down the CAB tommorrow, so wish me luck and i'll keep you posted.

went down to the CAB today, and you're right, they were very friendly. i also went to the courts to get a form signed and had to read out one of those "i do somlemnly declare" things. it is starting to look like things might be getting resolved but i will still worry about it until i know they cant take my caravan away.

Go to a stationers and buy a receipt book. Write some stuff out 'proving' that the caravan is someone elses property and they are just letting you stay there. Get a friend who knows the score so that any bailiff can call them to verify the caravan is theirs.

    I hate bailiffs

You should be able to buy a rent book too and make it look as if you are paying someone to stay there.

so if i said it was my dads and he let me stay in it coz he had no where to keep it then that wouldnt work?

i dont want to weave a huge web of lies coz im very bad at lying seeing as it involves a large amount of thinking before speaking, which i have never been good at!

thanks for the useful advice though

Only suggestions, but anything to say that it's not your's goes a long way.

It can all depend on a bailiff too, they have so much work that most of the time they won't bother investigating, and just take anything you tell them on face value.

    "Hello are you Ms Stardust?"

    "Who?"

Oh, you don't know her, ok then bye bye"

Sometimes it really can be as simple as that

Be aware that it is possinle for someone to initiate bankruptcy proceedings against you. if you get a letter along these lines then don't be afraid and ignore it but go to the court it is sa simple matter to stop it. if you dont then they will go ahead with the proceedings. They can't take what you don't have and pauls advice is spot on.

do not give any information that you are not directly asked for, their own red tape should slow them down
