Alright, so basically my friend was texting in class. The teacher say him texting, took his phone, and read his messages. he was messaging his dealer and talking about purchasing marijuana. She reported him to the office and he's getting suspended, and might get arrested? Can they do that?
That's SO wrong! I don't know if they can or not, but she had no right to report what she saw in his phone! If she wants to help him, leave the cops out of it, they're just going to fuck up his young life. So sorry this happened.
reading his private messages is invasion of privacy he can have all charges dropped and sue the teacher
Yea man i mean i think it's against some amendment. Like she took his phone without asking, read his texts without asking, and reported him to the principal, who then punished him, and reported him to the police. WTF!
Yea that's what i thought. They would have to treat it as a normal phone in school punishment. And just ignore the other stuff. Ha ha.
They're on school property they can look through any of his things. But there really isn't enough evidence for an arrest to be made so no need to worry. But, his fault for not taking out the phone battery before giving the teacher his phone.
He probably only had a few seconds to hand it to her, so how could he get the battery out? She'd just make him give her the battery. Your friend should definitely make sure he's not holding for a few days or at least find a good hiding spot, just in case.
if you're on school property.. the school has a right to search anything on that property at any time... whether its your backpack.. your locker.. your car.. or a cell phone
He wont get in trouble with the police. I could take out a god damn ad in the newspaper about buying marijuana and they couldn't do anything unless they caught me with it.
He probably won't get in trouble with the police, but they do have a right to search all your stuff without asking and without a reason, my school has a big sign infront that says "public building, all people subject to search" anyway, he might get suspended but I doubt he could get arrested. I'd be more worried about them using his phone to track down the drug dealer, if your school is anything like mine.
you have no idea what your talking about. he is a minor in a public school, he has no right to privacy other than taking a shit or changing clothes for gym an face it,theres not much privacy when it comes to those actions either.. can they arrest him ? i highly doubt it unless they just labeled him delinquent or somethin.. is it probable cause to go after his dealer?? quite possibly...
It takes more than a few seconds to remove the battery? So unless the teacher snatches it out of your hand, then there is no reason not to remove the battery.
If he was typing the message and removed the battery the message would have been lost, but had it been sent already; that wouldn't do shit. Yeah sure, they can look thru your shit is your suspicious. He was breaking the rule. I'd assume that's along the same lines as opening a cd player (remmeber those?) after taking that away. He can't be arrested. Is there a law "intent to purchase"? Anyway, the cops will know his name, and next time it's run, they'll probably get a "class D suspect" and search him then. He should have gotten the punishment anyone using a cell phone during class would get. In my high school it would have been a detention or maybe a day of in school suspension.
The point of taking out the battery was to prevent the teacher or anyone else from turning on the phone and going through his stuff...
shit, if you didn't want to let her get your battery so bad, throw it out the window so she'll have to ignor it. It's not like they are gonna go take the time to get it.
