Once upon a time, I had some friends and they were drinking. An argument ensued and things got out of control.. My friend John left the house to get a weapon and kill the other friend Karl, who is now an intruder because he dont want to leave and is fighting with John, his younger sister, and brother. Karl was a bigger dude and scary when drinking.. John smacks Karl in the chest with the axe 9 times, and that was that. They didnt call the police til the following morning. And the rest is history. John has no plans to appeal this. He allowed himself to fall behind with appeals intentionally acting up to gain single cell status. Time barred and commutation is his only way out now.. Of course hes very remorseful and believes he should be prison the rest of his life for doing what he did. Imo, I dont think he should be there for life. I knew Karl, he was an asshole motherfucker when drinking and I could put myself in John shoes. I could see myself that mad to just keep chopping away,,,but idk.. John left the home to get a weapon. There were other things he could of done to remove Karl. I don't know anyone in prison. He was so young when the murder happened. It seems like such a waste of ones life. He is talented and it sounds like a good program for the men.
I have a friend doing a nine year sentence for (DUI) vehicular manslaughter. Pretty good guy and feels a lot of remorse for his actions and his use of poor judgment. Working where I work, we meet with prisoners (County and State) all of the time. I have set across some murdering gang bangers, pervs, gassers, drug addicts, etc. For the most part only the gasser has ever really bothered me. (Surely didnt want to shake his hand). Its nice that your friend is able to participate in such a great sounding program and that the prison offers that. He is a great artist
I went to school with a girl who got 30 years for intoxicated vehicular manslaughter when we were 17 years old. It was just a few weeks before our senior year of high school started, I remember I was out with my boyfriend at the time and we had stopped at a truck stop and I heard her name on the TV and it was like the world just stopped for a minute. She'll be eligible for parole in 6 years. It's a very sad situation and I'm patiently awaiting her release because I have every plan of befriending her when she gets out. I don't figure she'll have many friends because the town and area has either written her off or painted her as this huge social pariah. People make mistakes, especially when they're 17 years old, and after spending all of her adult life up until at least the age of 32 (if not 47) behind bars, she's going to definitely need a friend in the "free" world.
I would treat Johns case like a vehicular homicide .. He fucked up, big time.. But the alcohol that clouded his judgement wasnt put on trial.. This was a drinking binge party. not just a few beers. It was a long time ago and John was only 22yrs old. Karls father is an asshole mean drunk just like his kid. Of course he thought it was over kill. Again John exhausted his appeals on purpose .. when I send him money and he calls on the phone, he wont talk about the past or any process that may help release him. If I bring it up, he hangs up the phone on me.. (lol I cant call him back. I have another friend in the same prison as John. He was convicted of murder too. This other guy punched a friend in the nose when they were arguing over crack cocaine. My other friend he left the home when the dude fell out and went home. 3days later he was arrested for the homicide. Convicted to life in prison , but its been reduced to 22yrs because his defense failed to bring up coroner report. The assault wasn't vicious/ It was just a punch in the nose. Hes been locked up for 17yrs- so hes good to go soon.
Your friend seems very talented, Orison. I have a uncle that's been in and out of jail for drugs and gang activity since I was 5. He just got out from his last stint about 6 months ago.
DAMN!!! 30 years??? that's a lot of time, especially for a minor. Damn, I still cant get over the whole 30 years things. Was there more than one victim? People in California, pending on the facts related hardly ever get that amount of time, unless they have had priors. You are a great friend . She is going to need all of the support she can get when she gets out.

Well there were two people in the car that she hit, 15 years for each. It was really just the prosecutor throwing his weight around and trying to "prove a point," though, honestly. He bragged about how he had tried for 20 for each (the absolute max) but 15 each would do, "to send a message to all these teens out there that your age is not going to protect you." Funny that the prosecutor was caught less than a year later in a drunk driving hit and run. He's not the D.A. anymore (thank god) but seriously, what a piece of shit.
No, the other friend his name is Ervin, he was smoking crack with this other guy. They argued over the crack and Ervin punched him in the face. Ervin left the home and wasnt aware dude was going to die from the punch. There wasnt any additional crime, no robbery. The guy was where Ervin left him , on the couch drowned in own blood. Ervin used to live in this apartment building across the way. He played the saxophone outside , it was a cool sound in the evening. Because of the distance it was really the coolest thing. I dont really know to much about the dude he killed. The victim was from the DC area and only here for a short time. My friend John, he is a musician too . Had I spent more time listening to him. I would know more about guitar theory .. But our lives separated some before the axe incident. We went to the academy together / like a special high school, he joined the navy and I the army.. We only seen each other a few times after that. John worked on the hydraulics aircraft carrier lifts. He would draw pictures of anything like in 3D ,, He could actually draw money - if he wasnt in prison for this , He might be for counterfeiting..
i went to school with a guy who is serving i dont know how many years for murdering a girl and driving around for 3 days with her stuffed into his car trunk. I doubt he's doing anything worthwhile in prison. that painting was pretty cool. The murder really brings a new light to the phrase best friends for life
I can't stand DA's that are like that. My friend was a firefighter, the DA was the same way. Wanted to make am example out of him. Was asking for the high term, and then add a ten year enhancement. I want to say he was looking at 14 plus the ten. Nine years (which was the midterm sentence) is a long time, but not nearly as long as your friend received. Can't believe they didnt run it concurrent. We had a DA who was in the DUI division , wreck his motorcycle and pass, he was really drunk. Just goes to show that people just use poor judgment at times . Pretty sad all the way around for all involved in this type of situation.
