    Then he's also the first guy to get poped when shit goes sour.... and that deal might not end when the smuggling deal did.

    And the amount of THC don't mean shit. If you sell a bag of chicken seasoning as pot, it doesn't matter what it really is, you sold pot.

    not necessarily..sure he could have ratted, but you'd be surprised what people can get away with just by getting the best possible lawyer...

    when my partner got pinched, he was looking at 20 years behind bars... I immediately ran out and got the best lawyer money could buy and he's a free man today; not even probation... and that was a charge for transporting controlled substance, serious shit.

    police fuck up in procedure all the time when making arrests... the problem is, most people simply don't understand or know what proper police procedure is when making an arrest.... if they fuck up one little thing, it can drop the whole case.

    My lawyer already originally pushed the court date back, I am officially only being charged with PoM and nothing else. After working with my lawyer for the later part of this month and seeing exactly where we stand with everything. There is a small chance everything will be dropped or ill be facing a 1-3 month probation, with it later expunged off my record. I passed the drug test taken the day I got out of jail, so that helps a lot.

    Because nothing was found on my persons, or in any compartment of my car, that also helps. The friend in the back seat was caught on camera saying that the weed was his, as well as found on him. And he has no problem taking the fall.

    As to my original statement of "I was in State Pen" no thats not true at all. I was in county jail. I was a bit shook up, and having never even had a speeding ticket before I never fully understand that side of the system so I looked at it from a glorified Hollywood position.

    As to if the cop actually said HALT or not, probably not. The video of us getting arrested doesnt start till AFTER he found the pipe, as it was outside the car he walked over to his car and turned on the camera. Regardless, I was in a state of shock, and I wrote the post a day or two after I got out.

    Either way come Monday, i face the music. Find out exactly what I get, I am not to worried, ill just face what im charged with and put it behind me.

    But given all that evidence, your lawyer is telling you, matter of factly, what you WILL get, when you could take a jury trial and probably face nothing, because there's no shit on you.

    Also, your lawyer lied, as they often do, mine did.... it will NOT be expunged, it will be "deferred dismissed", or something like that. It means you basically admit you did something, jump through the hoop, and the charge is dropped. However, because ti's not a conviction, it NEVER goes away, even if your record IS expunged. You can get it sealed so that nobody can see it, but that's a semi-big deal. It is generally treated as a conviction, even if it's NOT one, and I have encountered applications for everything from jobs to housing that ask about deferred-dismissed charges.

    Doesnt this vary from state to state? My lawyer has gotten 5 different possession charges dismissed in court.....I never even had to show up to any of them. I've been working on expunging all of my charges over the years (1 DUI, 7 PoM, and two PIs. Lawyer is telling me that 2 years after the date of each expungement (is that a word?) each charge will be as if it never happened. Whether I was convicted or not. With the exceptions of if I get a second DUI, in that case my charge/conviction won't actually show up, but my file would have a red flag noting to give me the sentencing equal to that of a second offense. That and one PoM that I got out of State. He can't touch that one. I'm pretty sure I remember him telling me the different expungement (?) processes in my state and those surrounding. But I could be wrong.

    One thing I've learned about the justice system, especially for nonviolent drug crimes, is that the best lawyer doesn't have to be good at lawyering. He just has to be connected. A connected lawyer on your side changes the whole game

    All true, but I'm specifically talking about probation. The motive to keep you from taking a trial, when the plea offers you probation, is generally that the plea also doesn't count aas a conviction.... but in actuality, it might as well. We're not talking about probation as part of actual sentencing in an actual trial.

    It's all about favors between them and the prosecuting attorney.

    Yeah so in the end im getting a year probation. At the end of the probation i can have my case sealed, but it will always be there.

    I decided, unlike a lot of my friends to just play it safe and not do anything. They abide against drinking and what not, so i wont. Just ride out the 6 months and get it over with.

    I've been to jail once for possession. I find it hard to believe that they locked you up like that for that much weed. But then again I don't know the laws in Texas. I had a half and they gave me a ticket and sent me on my way. A nice $1700 ticket though. Only because it was a sheriff and not a city cop (their tickets are generally more expensive everywhere you go.)
