Is it constitutional to ban smokers from working?

    So the City of Fort Worth is discussing banning smokers as future employees. Not smoking-smokers. Their reasoning being they have higher insurance costs on these people. Would like to hear everyone elses thoughts on this!

    I'm sure they will get away with it... if it's illegal now they will just change the laws.

    If it's unconstitutional they will remind everybody, that document is basically toilet paper now.

    One of the first things Nazi Germany took away from the people was the right to smoke. Just saying.

    It's a way of "conditioning" the people. Because smoking is unhealthy it's easy to make it look like their protecting the public, but really they're just getting people used to the idea of losing personal freedoms.

    As for refusing to hire a smoker, even if said smoker agrees to not smoke on company property......of course it's unconstitutional. It's bullshit. Smokers usually pay a higher premium, which is understandable. But discrimination is discrimination, no matter who it's against.

    Workers have no rights in this country . because of union decline . Very little is covered by the E.E.O.C. as far as discriminatory . race , Age , sex , religion is about it I think . This is not covered as basis for discrimination . So an employer could reject someone for smoking I would think . Like anything else until its legality is challenged by law, they can do what they want .

    Not to long ago a post was made on here about employers asking for potential employees social media account passwords . Now if it's against the law to ask a persons race, age , religion on an application , because such questions may be used to discriminate against a potential employee . Then what do they think checking a persons social media site could do ? Again it must be challenged . When enough people file n.l.r.b. complaints maybe the laws would change .

    in all honesty smokers do drive up healthcare costs.

    not that it makes this okay. I think making the workplace a smoke free zone should be enough.

    after all, obesity drives up healthcare costs too and I don't see anyone trying to fire employees who take their lunch breaks at mcdonalds.

    Funny they'd try and make a law or anything though.
    I mean you really think that every company doesn't discriminate when there are laws against doing so? HA! Im sure if there are places where it's held that smokers are disliked for the constAnt breaks then they won't hire you if they know you do lol I've seen this all first hand

    They are indeed Aerianne , and to date it's acceptable and not against the law . Because the E.E.O.C. doesn't recognize it as discriminatory . Gay people either . Only race , age ,religion , sexual harassment . And without their "blessing" these people have no case or recourse .

    With health care prices skyrocketing out of control . How long will it be before employers refuse employment or terminate smokers , obese , pregnant women , or anyone with an underlying expensive health problem or risk of one ?

    My husband was canned from a position he held for 27 years, with a major corporation, shortly after the bill from his hospital stay hit the insurance company. He is a Diabetic. The reason they gave for his termination was "Position no longer fits our corporate strategy".

    Yeah, it's been happening for a long time already.

    I think its a load of shit. But with the way the country has been going batshit crazy on this anti-smoking crusade the past decade or more nothing will happen to these businesses. Granted they can put in to place whatever pre-req's they wish but singling out smokers just seems fucked. They portray smokers as some kind of second class citizen that is lazy and always missing work. Which, in my experience, is completely opposite from the truth. Smoking is the one thing that gov't can clamp down on and suck all the tax revenue they want out of it with little or no fight. Soon they will use the tobacco companies up and move on to the next social pariah, just what will that be, who knows.
