I have a stalker.

    I have a REAL stalker. I called the police and I filed a complaint with the town office. I even applied for Legal Services to get a protection order or restraining order. I found out that I can't qualify for either and I'm pissed. The police said they'll talk to the person and "tell them to stop being an asshole". The only way I can get a PO or RO is if there's an arrest.

    This has been going on for almost 6 weeks now.

    Ready for it? GUN CONTROL. Let me tell the whole of the United American States something right now.

    I've made the tragic mistake of being angry instead of FORGIVING the offender. The anger was all consuming and I've suffered at the soul level because of it. What I learned:

    1. Do not EVER "sleep". You know how people are always barking at other people, "WAKE UP, PEOPLE!" well, DO THAT. Wake up. And when you do wake up, don't ever ever ever ever ever ever ever fall. Back to sleep. Ever. Again.

    There doesn't need to be an arrest for a protection from abuse. Whatever cop told you that is dumb. You need to talk to someone else.

    I got a pfa against a guy.... an ex.... one time. I went right to the county courthouse in the area that they handle that and flat out told them what was going on. That the guy was stalking me, had beat me up and put a knife to my neck and threatened to kill me. It was over 15 years ago so I do not remember if I had marks or what... there does have to be some sort of reason that they can see but I never had the guy arrested and I know that is still just ONE of the criteria they can use to qualify for one.

    Laws on PO or RO may vary from state to state. The cop may not be giving you the right info, but maybe.

    In at least some states, you can get an RO if you pay a fee of about $150. If you can't afford it, you can get one for free, but you have to fill out a huge stack of papers to do it.

    You may want to talk to a legal aid organization if you can't afford a lawyer. They may have some tips for you about how to handle the legal issues, and it may be that you can get an RO after all.

    There may be some helpful info on line on how to handle stalkers

    That's fucked up. Sorry that this happened to you.

    Ex's are the most likely stalkers, I think.

    I used to have this illusion that if someone broke the law, it would be likely that they would get punished.

    Thanks. :) It was a long time ago obviously and I'm over it. But yea, it was a crazy situation. This guy had me scared to death for a long time. I should have had him arrested but honestly in my mind I just wanted him OUT OF MY LIFE and I didn't wanna have to deal with court and seeing him again to testify and all that. Luckily w the PFA, I think he tried to see me twice more and finally got the hint and left me alone.


    Anyways, yea, I'm sure those things can vary state to state and when I got mine it was a long time ago, but I'm still pretty certain in every state (I'd think anyways!) there can be more than one criteria (an arrest) to be able to get a PFA.

    Yeah, illusion. Things are so twisted that if I defend myself, I'd most likely be arrested and charged with assault.

    The stalker isn't an ex (THEY WISH) but just the idea that anyone would look at it that way makes me unbelievably hostile (and it also makes me vomit in my mouth). I said it straight out: I reserve the right to defend and protect myself, by any means. That's not a threat but seriously, there are some VERY real mental problems in this country. SOME people, including "law enforcement" or even government, would consider my reservation of rights to be a threat. O. M. F. G.

    I called Legal Services. They told me the way it works in this state. I don't qualify (there's been no arrest). I'm entirely on my own about it. It's me, a government provided cell phone (to call 911), my big mouth and my gunless weaponry. I got no faith on this one. Nope. None at all.

    I actually talked to two, the one who's face I shut the door on and then the supervisor who stopped by later to get the job done. It was funny the next day and every day thereafter, everlasting.

    The only good thing on my side is the PD here knows the person very well. They call him "the hamburglar" because he robbed a McDonalds for 20 grand, got caught and went to prison. Now he's just a homeless junkie who got starry-eyed over me. Trust me, I don't take it personal at all. He just found a new way to get HIIIIIGH.

    Sorry somebody did that to you. Humans are monstrous creatures.

    That sucks that the rules are like that in your state. They should be trying to prevent arrests (by allowing pfa's...which sometimes anyways, work.) instead of making something happen first before they offer any help.

    All I can suggest is to get him arrested. Take that how you want to. ;)

    mmhmm, "evidence" first .. then response. I figured his criminal history is enough to substantiate my complaint and honor my request for legal protection. Nope.

    Oh well, I'll see how it'll play itself out.

    A gun?
    Maybe start with pepper spray, that stuff ought to work well its much easier to get ahold of and the legal consequences are much much less if you use pepper spray. Kinda sick that we have legal consequences for victims who defend themselves these days.

    You're right and I have thought about getting pepper spray. I probably will get some. It'll make me feel better.

    The number one reason why defending myself would set me up for criminalization is because of my history. I knocked my ex-husband's teeth out (lol) because he put his hands on me. Typical case of self defense but because I couldn't prove that he hit me first, and there was evidence that I hit him back, I got arrested, charged and went to trial over it. I ended up in county jail.

    So yeah, there are legal consequences for .. well, just being in a problem situation to begin with. Another reason why I'm so pissed off with this fucking moron. Things would've been perfectly fine if he hadn't been a delusional idiot and made the transgression that he did. I fail the Jesus Christ prescription of forgiving. Shame on me.

    Still want me a gun, though. :D
