(b) (1) A person commits the offense of feticide by vehicle in the first degree if he or she causes the death of an unborn child by any injury to the mother of such child which would be homicide by vehicle in the first degree as provided in subsection (a), (b), or (d) of Code Section 40-6-393 if it resulted in the death of such mother. Its confusing the way its written. This come from Georgia law page. http://www.lexisnexis.com/hottopics/gacode/default.asp
The way I read it he ran her down killing her and the fetus (1 count) and to be sure ran over them a second time (count 2) Not real sure how he killed them twice (???)
Ok so I googled some and the only thing I can think of how he got two counts of FIRST DEGREE feticide is stacking up a) feticide and b) vehicular feticide to get two counts. On the other hand I re-read the article and it says "two counts of vehicular feticide in the first degree" So either someone explains this to me in real engrish or I'm calling it a mistake.
I thought it might be a mistake by the paper, so I went back and looked at other reports and they all say the same. Like this story from Dec. 2012 http://www.henryherald.com/news/2012/dec/07/feltman-indicted-death-pregnant-girlfriend/
this makes sense too. Ive seen DUI cases be 2 counts because the actor stopped and got out, and then took off again.
Okay, someone on her facebook page answered me but I'm still trying to get it more clarified from there. She said "He hit her and her drug her". Like I said I'm waiting for clarification the those two things are the reason for the two counts.
