First time caught...shit happens..

Well about august 6th I got caught with my pipe. They didnt take me to J.D all they did was write a ticket and take me home. It says refferal not complaint to juvinile court so I dont know what will happen. Drug pariphinila.(I dont know how to spell that) Me and my friends were going for a walk to smoke a bowl I was already high and looked down and next thing I knew a cop car was there. He was gonna let us go then he asked for a "quick pat-down" said he wouldnt reach in my pockets he felt the pipe. I said it was my lighter he was like ok then he stared pulling it out and i just adimited to it. So will that help me in court if it does go to court?

 

why didnt you just say no to being patted down?

 

The officer had the right to do a simple pat.

no he didnt, an officer only has the right to physically search a person if they 1. give up their rights(which you did)
2. are suspected of a crime involveing a weapon, or suspected of carring a weapon(which you were not)
learn your rights and you wont have much trouble

 

i think theyre allowed to do a pat down, just for their own safety... if they can't feel a weapon you should be good

 

It's such bullshit that you can be ordered to do things by the state for carrying an EMPTY PIPE. What if it's for tobacco? What if it's for grass? What if it's none of your fucking business what I smoke in my pipe? Gah, freaking arbitrary drug laws.

 

lol they would throw your ass in the back of the paddy wagon so fast. they are entitled to a pat down - and depending on your state (keep in mind I am canadian) you have to show them your id or they can take you away.

 

my geuss is your young and dont have a whole lot of experience with the law, most cops are fuck heads, they love it when you dont know whats goin on and you dont know your rights

a couple things ill advise you to not do in your years to come
1. if you get busted and a cop tells you your buddies told them what happened dont say anything, usually its just a trick to get you to give up info that will probably screw you over in the long run
2. dont snitch, the last time i got arrested was in april, i had a pipe and some bud on me, once i got to the cop shop one of the cops tried to get me to tell him some names of dealers i know, in return he said he would have dropped the pocession of marijuana charge(i assume he did this because i only had about 2 bowls worth of weed), i told him i aint a snitch ill take the charge, he was like ok, about 15 min later he told me he wasnt gonna charge me with it so that was cool, but then the first time i met with my po he told me i was gettin the charge, anyway im ramblin, but nobody likes a snitch, snitch once and youll be known as a snitch forever

im not tellin you to go out and rob some people but be smart when you break the law, nobody gets caught on purpose,when your doin somethin illegal and see pigs stay calm when people get nervous they make stupid mistakes, ohh and im not sayin all cops are fuckers but most of them are on power trips cause they got a gun and a badge and no matter what its your word(a civlian) verse them(cops) there are some decent cops that treat people with repsect though, and one last thing KNOW YOUR RIGHTS

thats right Jimmy, but its all about responsibility, your responsible for your own actions, Most actions dont have the cops messing with your hair.. but doing dumb kid stuff it usually gets cops attention..
Since he is a juvinile. hes liable to get searched for not only the cops protection. But general public protection. not to say kids carry things they shouldnt.. But thats just the way it is..
I see cops sitting in patrol cars all the time as stoner kids pass right by then and walk into the woods take a path to a store, come back with munchies and still walk past the cops sitting in car doing paperwork..

It's people like you that honestly piss me off. The HF use to be full of great information on your rights but now people like you can't even take 5 minutes to Google "Terry Pat" and read a couple paragraphs. Because of that case an officer has the right to pat you down if you are suspected of having a weapon BUT it was more or less interpreted as a simple pat down was for the officer's safety and any suspicion gives them the right to pat you down.

From the few short articles I read, it seems like you can then refuse to be physically searched unless the officer specifically feels a weapon on you. I may be wrong on this as most of my information came from Wiki.

He didn't have the right to search you, unless you were doing something suspicious. You did waive your rights though.


Bottom line, the police know the laws and the loopholes.


They know exactly what they can get away with.

Also, remember that being out past curfew strips you of many of your rights.

 

A cop can pat you down because he is checking for weapons for his safety. I think they can't pull anything out unless they suspect it would be a weapon...

 

You should make a pocket at the crotch area and hide your pipe there. while patting you down if the cops feel it and ask you what it is, you can always calmly say "its my dick sir".

 

I'd just be like "Officer, can you kindly remove your hands from my penis?"
