    Remember on Sept 5th when that bitch ran me off the road, and I rolled my truck a bunch of times? I got a reckless driving ticket for swerving to avoid an accident. I went to court and plead not guilty. Yesterday I went i and talked to my public defender, and she's telling me that I could lose my licence, get a huge fine, go on probation or possibly get 3 months in jail. Bullshit! I will be so pissed if I go to jail over something like this. I know I'm not going to walk away scott free or anything, the government wouldn't get their money that way, but jail time for trying to avoid an accident? Let this be a lesson for all. If some bitch cuts you off and locks up her breaks, drive your vehicle straight up her ass. then you could get a following to closely ticket or something, instead of potential jail time. If you don't see any posts from me after the 14th of next month, you know why. Hey, what kinda bird don't fly?

    that is so unfair. after all that you and your wife suffered! man, i cant believe it. why are you getting punished for all of this? it's just not fair. i hope it doesnt end up half as bad as it sounds :( And still cracking jokes........what an amazing guy ;)

    That's absolutely ridiculous. Sure, I don't know the entire story from both sides of the fence but geez, that just doesn't seem right at all. Hopefully it won't be as bad as that.

    Hey HippyLandScaper,

    Although My injuries were not as severe, and my family was not with me at the time (thank god!!) I had something very simular happen to me in April of this year.

    I was in the outside lane of two lanes turning left, the woman in the inner left lane was lined up with me in front of the red light, as soon as it turned green we both started to turn and come onto the other road. she came into my lane so fast and my instinct was to swerve and try to avoid it (wish I hadn't!) It was just grass and dirt and plenty of room on the side of the road and I would have been fine if I swerved a few inches after the guide wire attached to the telephone pole was, but I didn't see it. My right front tire caught it and my car rolled almost two whole times.

    My car looked like it was hit by a semi! If it wasn't for my seatbelt holding me in I know I would have gotten thrown from the car cause all the windows pretty much blew out.
    and because I swerved, her jeep never made contact with my car, and my lawyer said the woman’s insurance said they won't pay because it wasn't the woman’s fault! (what the fuck, right?) so my lawyer said the only other option is to sue her personally.

    The woman behind me witnessed the whole thing and told the officer that I was force over by the woman in the jeep and even the officer told the woman it was her fault, and tried to explain about the lanes still being two even after turning, see, once the two lanes turn onto the road it remains two lanes, but there is no lines to define it, most people (people with common sense anyway) know this because there are TWO lanes turning left and no sign indicating any type of merge.

    it really sucks because I had just gotten that car a few months before and put $800 into it, also it was several hundred dollars in medical bill, towing of the car, loss of work and lots of extra money for gas and tolls of driving my husband back and forth to his job so I could use it to get to mine!

    It sucks to go through something like this then have her insurance company say they won't pay!
    I just want some compensation for money I spent, I'm not trying to get millions ya know?

    Anyway I'm happy to be alive and I'm happy to know you and you family are okay too, I'm really sorry about your situation cause I know how much mine sucked and yours is a hell of a lot worse then mine, sorry about the long story, I just wanted to tell you because in a small way, they are similar, the part about trying to avoid an accident, and ending up with something worse happening!

    I really can't believe they would try and charge you with that and consider jail time for you, I really wish you the best of luck and hope you don't have to go though with that shit!

    i had a guy try to get me to hit him a few times. probably some insurance fraud. i was driving to school, and this old beater darted in front of me and slammed his breaks. i got around him (miatas DO handle VERY well). he did that TWO MORE TIMES. i finally darted right and pulled up at a police station. fucking asshole freaks.

    good luck with your court date. that shit just isn't right at all.

    You know what is sad, the police report dosen't mention anything about us driving wrecklessly. You know I have no clue what I will do if he goes to jail, all im doing right now is hope and prey to God that 3 months does not happen. I hate thinkng that he'll miss Christmas with his son. Iam more and more dislikeing the damn government. My mother in-law brouth up a good point, isn't his Lawyersuposed to call and try to get the police report and see if she can call the witnesses?

    yes, get his lawyer to call the witnesses from the police report. definately do that.

    uck something like this happened to my family this august. We had gotten our first NEW minivan and took out a loan for it. It was raining and Chris was on his way home from work. The asshole in front of him decided to stop in the middle of a very busy highway at a green light and turn without turning on his turn signal or giving any sign of turning until he stops dead in front of Chris in the middle of a bad rain storm. To avoid it he slammed on his breaks, flipped the van and it slid and slammed into a dump truck. Completely totalled. He should have died but crawled out with only a concussion. Alot of people saw and reported there was no way for him to avoid it and that he was following proper driving rules. The asshole never stopped to find out if he was ok. He got a ticket for reckless driving and now we have to pay the some of the loan back since insurance won't cover it all. His liscense may be taken away. We had it a month, it was new. :( It was his last day of work because he is a full time college student(he works just not a great paying job) We found out two days later we where having a baby. A month later I had to quit my job due to my health. Now we're drowning in debt and some asshole is out there driving like an asshole still.

    in cali reckless driving means you can lose your license for 6 months, (could have a DMV hearing to prolong when its going to happen. You should have gotten something from them by now). The 3 months in jail is more than likely NOT going to happen, its always under the penal code, that is probably the lesser term and it is your PD's job to tell you what can happen. The fine in cali is similiar to our DUI fine for first time DUI its about 1619 which a person can make payments on.

    Check out your states Penal code( Reckless driving,) it should tell you more info on what can happen to you.
