That is bullshit that they could even charge him for that when they were looking for a suspect and find marijuana instead. Something about that power needs changing.
why would he let them in? they need a warrant, and he could have gotten the plants and rest of shit out. that really sucks though.
It was completely illegal what the cops did. Your buddy should learn his rights. Refusing a search is not proper grounds or reasonable cause to be searched. He has a pretty good argument, and might even stand a chance of being acquitted.
if the plants were already hanging shouldnt he just get charged with whatever weight all of the branches weighed?
Ok... i can attest that when cops come inside looking for a criminal they are in pursuit of.. that what they find inside can't be held against the owner. Ive had a very close friend have this EXACT problem. Get a lawyer, NOW. Tell your friend to shut up and speak to a lawyer.
It gets tricky. It would have been a lot easier if he didnt consent to the search. Then the cops legally couldnt do anything. I would definitely recommend getting a lawyer though.
we need to sticky the know your rights video. If you know your rights you protect yourself and your friends. I think the reason people are saying more about him letting them in then them charging him with 80 plants...is ya cops are dumb...but letting the cops in without a warrant is even dumber.
if you're hanging close to 10 lbs of weed in your house, why the fuck do you not have a carbon scrubber (or several) going? did he not realize it was going to stink up his entire house and that if a cop or neighbor walks by an open window they will instantly know? you have to take basic precautions when doing this kind of shit. a decent carbon scrubber would only run him 150-200$ tops, and when he clearly was going to earn thousands on the weed that's a tiny investment for a lot of security. unfortunately now he is going to spend thousands in court and legal fees. either way, it sucks for him indeed but he should have known better.
That video really isn't great. It only begins to approach the basics in your 4th amendment rights when it comes to getting pulled over.
