check this bullshit out via RT: The day after prosecutors cleared a police officer for shooting a man eleven times and killing him, attorneys representing the victim released a graphic video showing the shooting. The San Joaquin Country district attorney’s office concluded that California Police Officer James Moody had been legally justified in shooting 34-year-old Ernesto Duenez Jr., but the video might bring the case back to court. On June 8, 2011, the officer ordered Duenez to get out of his pickup truck, which was parked in the driveway of his house. Duenez was on parole and was wanted in connection with a domestic-violence incident that occurred earlier that day. When the man exited his vehicle, Officer Moody immediately opened fire, shooting 13 times and riddling the man with 11 bullets in 4.2 seconds as he rolled on the ground. Duenez was shot once in the head, eight times in his body and twice in his extremities. Four of these shots occurred while he was already on the ground. He died shortly thereafter from gunshot wounds to the chest and abdomen. While the officer was firing his gun, the victim’s wife ran out of the house, screaming at the officer and subsequently crying over her husband’s dead body. Moody claims he shot the victim because he saw Duenez holding a knife. An 8-inch knife with a 4-inch blade was later found in the bed of the truck, but Duenez was not carrying it at the time of the shooting. The footage also shows the victim’s foot getting stuck in the seatbelt while he was trying to exit the vehicle. The camera footage contradicts the story told by the officer, showing a situation in which Duenez posed no threat to the police. “This is more barbaric than even the Oscar Grant shooting,” Oakland attorney John Burris, who filed a wrongful-death lawsuit, told the San Francisco Chronicle. Even though Duenez was a known gang member who had violated his parole by failing a drug test, prosecutors claim he was in the wrong by fatally shooting the unarmed man. Rosemary Duenez, the victim’s mother, agreed to release the video in response to the court decision to clear the officer of the crime. After Burris showed it to her, the 58-year-old woman said she hopes the video will garner support from others. “As heartbreaking as it is, people need to see what happened,” she told the Chronicle. “They need to know what we see, and what we’re fighting for.”
Ya, sounds about right. Thought he had a knife, emptied his weapon on him, even after he's down on the ground. Maybe they'll just send him back to the shooting range to improve his grouping.

I don't hate cops. PERHAPS the cop should have incapacitated the guy. It does look as if the man is reaching for a gun, and he does try and get up - who knows what he could have done. Shooting him 11 times - once in the head and 10 times in various parts of his body, seems a little excessive. I don't think you can just brush it off as 'just doing his job', with out an investigation, can you? Every instance of this type (cop shoots somebody) is investigated here.
i just watched the video on another site with better quality. cop told him to keep his hands up and not move. dude jumped out of the other side car, and u can hear the officer say drop the knife. He should have learned to listen. cope knew him by name, was prolly a repeat offender. why dont you guys post all the articles about cops getting shot by people???
:toetap05: To be fair, it doe all happen very quickly. If I knew a cop was behind me and I'd pulled up in my drive knowing the cop was getting out of his car - would I try and get out and make a run for it? NO. If I am a cop and somebody jumps out of their car, turns around and reaches into their car - would I know they might have trapped their foot in their seatbelt (must be quite a challenge to do that)? - Probably not. What's the first thing I'd think about? - my safety.

Sad situation....I offer these comments, as a firearms (pistol) expert and as a martial arts instructor. Everything happens so quickly to us..... Cops are taught that if their gun is used, it is used "centre of mass" until the target complies, or stops. They are specifically taught NOT to shoot at hands or feet or legs, because of the additional risks to bystanders and the fact that a drugged perpetrator may not be stopped by a limb wound. Also, 4 seconds seems not long, but tachypsychia is a real phenomenon, by which time seems to slow down for the participants. My sympathies to everyone involved.
Duenez had prior convictions for burglary, statutory rape, possession of controlled substances, felony evading arrest, vehicle theft, possession of a stolen vehicle, assault with a deadly weapon and participating in a criminal street gang. Innocent man indeed.
based on the video, the guy was pretty much trying to get himself shot. that said, there's a big difference between shooting someone to neutralize the threat, and unloading 11 shots into someone from 10 feet away who you believe to be carrying a melee weapon ("drop the knife").
You shoot to kill someone who is a threat. He could have been on drugs, and shootiing someoen once or twice who is on a certain kind of drug might not kill them. put yourself in a life or death situation. ur not gonna just try and hurt someone coming at you with a weapon..
Normally, I'd agree. But it's hard to see form the video whether the cop could have been sure that his early shots struck the guy. You can clearly see one near the end, but the cop may-I don't know, I'm speculating-have simply kept shooting because there was no apparent compliance and he wasn't sure that the guy was incapacitated. Tests conducted by a NY ex cop and expert witness years ago showed that a guy carrying a knife could cover 10 feet and kill a cop in less time than the cop would have to draw and use his/her gun. That's one reason they are a bit paranoid. As i say, sad for all concerned.
i agree. why does the cop(s) fire his gun 13 fucking times at a guy with a knife? how about ONE shot? BUT...apparently the guy didn't even have a knife. so he was unarmed. one shot to the center of mass probably would be sufficient. rollin, so because he COULD be on drugs, they are supposed to empty their whole clip into him??
Sadly true. There was a guy in NYC years ago aon PCP who took several hits from a 357 and a 45 after killing one cop, and he kept going until a 45 bullet broke his hip, inducing mechanical collapse. anyone interested in this topic who wants to read up on it, Massad Ayoob is a good start.
