We can have justice whenever those who have not been injured by injustice are as outraged by it as those who have been. --Solon (594 B.C.) California: Unscientific Per Se DUI Marijuana Measure to be Heard Tuesday Friday, 19 April 2013 Legislation is pending in the California Senate, Senate Bill 289, that seeks to "make it unlawful for a person to drive a motor vehicle if his or her blood contains any detectable amount of a drug classified in Schedules I, II, III, or IV of the California Uniform Controlled Substance Act." Senate Bill 289 has been referred to the Senate Committee on Public Safety and will be heard on April 23. You can read written testimony in opposition to SB 289 here. Under this Act, prosecutors could charge individuals, including state-qualified medical marijuana patients, with DUI cannabis solely based on the presence of trace levels of THC in their blood, regardless of whether further evidence of behavioral impairment is present. According to the US National Highway Traffic Safety Administration's website, THC blood levels are poor indicators of cannabis-induced impairment. NHTSA states: "It is difficult to establish a relationship between a person's THC blood or plasma concentration and performance impairing effects. ... It is inadvisable to try and predict effects based on blood THC concentrations alone." California NORML and NORML successfully lobbied against the passage of similar legislation last year. Sacramento NORML is running radio ads across the state in opposition to this measure. You can listen to the advertisement here. California NORML and Sacramento NORML will also be hosting a rally against SB 289 on Tuesday, April 23 at 11am on the west steps of the capitol, you can RSVP to that event here. Please take a moment to contact your Senator using a pre-written letter to oppose this legislation by visiting NORML's 'Take Action Center' here: NORML has additional resources relevant to this issue here: * Cannabis and psychomotor performance: A rational review of the evidence and implications for public policy * Imposing Per Se Limits For Cannabis: Practical Limitations and Concerns * Cannabis and Driving: A Scientific and Rational Review Additional information about this hearing is available from California NORML. Are You High? CA Bill SB 289 and Sen. Lou Correa Cultivate Clueless Legislation SACRAMENTO: Hearings on Sen. Correa's zero-tolerance DUI bill SB 289 have been set for April 23rd before the State Senate Public Safety Committee. The bill would outlaw driving with ANY detectable amount of marijuana or other controlled substances in the blood unless taken on an MD's prescription. Because traces of marijuana can remain in the blood for days or even weeks after last use, the bill would potentially criminalize every driver who uses marijuana, no matter how responsibly. Since medical marijuana is not prescribed but recommended, the bill would jeopardize medical as well as non-medical marijuana users - but not drivers who misuse more dangerous prescription drugs. NORML strongly opposes SB 289 on the grounds that scientific studies have shown that blood tests are incapable of determining driving impairment. According to the US National Highway Traffic Safety Administration,"It is difficult to establish a relationship between a person's THC blood or plasma concentration and performance impairing effects. ... Are You Drunk Correa? CORREA INTRODUCES SB 289: ZERO-TOLERANCE DRUGGED-DUI MEASURE February 19, 2013 LAW ENFORCEMENT BACKED BILL Sponsored by the California State Sheriffs’ Association, California Police Chiefs Association, California Narcotics Officers Association and International Faith Based Coalition, SB 289 would join 17 other states and make it illegal for a person to drive a vehicle if his or her blood contains any detectable amount of Schedule I, II, III or IV drugs. SB 289 excludes medicine used with a valid prescription issued by a licensed health care practitioner. Over the counter medication (allergy, cold and cough medicine) do not require a prescription and thus are NOT a scheduled/controlled drug. "The anti-marijuana campaign is a cancerous tissue of lies, undermining law enforcement, aggravating the drug problem, depriving the sick of needed help, and suckering well-intentioned conservatives and countless frightened parents. The study uncovered some interesting things: * The number of drug testing dates of service increased 4,537% * The total amount paid by employers and insurance companies for drug testing increased 19,164% * The average amount paid per date of service increased 315% * Extrapolating the results to the entire worker’s comp system, it is estimated insurance companies and employers will have spent nearly $100 million in 2011 and is expected to reach $150 million this year Exclusive: U.S. drug testing firm probed for alleged fraud, intimidation Appel said the company is a leader in business ethics in the estimated $4 billion industry that helps doctors monitor the soaring use and abuse of pain drugs.
