busted over a stem!

i fuckin hate cops, i was busted for possession on fri because they found a fuckin stem in my car in a canister that i never had(if i had known it was there, nothin would have happened, as if i just carry just a stem around with me)
I'll admit we were smokin duh, but the hell if i'm gonna admit it to a cop.

They smelt it so they searched the car. fuckin dumbasses never found the pipe though, stupid fuckers, my friend stashed somewhere when they pulled up. I really dunno where the canister came from, which pisses me off, if i t had been mine i wouldnt care & now i have to go to court cuz of someone elses stem that they left in my car.
anywho, we went a smoked a victory bowl after that(cuz they never found the pipe & didnt search my friends backpack where there was weed).

So i guess i shouldnt be too mad, it coulda been worse if those cops werent so fuckin retarded

Don't know about where you live, but I know that its basically established law in many places that they can't charge a person unless they actually have a usable amount of a substance. For instance, it is why Lindsy Lohan wasn't charged with coke possesion, she only had .05 grams, which wasn't considered enough to be possesion.

I'm not a lawyer and am not giving legal advise but you may also look into the U.S. controlled substance act 802 - 16, the state laws are usually pretty much the same. You might think about possibly arguing that the stem/stalk is hemp as excluded by the law from prohibition.

802 (16) The term “marihuana” means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.

 

you know so far i've had a few people say they cant charge me for a fuckin stem, but i'm not sure & their doing it anyway... it was probably a cop from evergreen and their fuckin dicks there & i dont live that far from there.

that's weird...evergreen cops used to bechill when I was in high school, but after those deaths (where the kids cut out of school, got stoned, rolled a jeep) last spring in evergreen or conifer, I'm sure their cracking down

^^^ you forgot the critical part of the equation man, her age. The denver law applies to those 21+. The state law makes less than one ounce a petty offense, I'm not sure if age plays in here, with a fine of up to 100

 

evergreen cops have always been dicks ever since i can remember. i dont think it was justin rolling the jeep that totally made them crack down, but it did at our school. theyre so much fuckin strickter about catching underclassmen going off campus now(everyone in that jeep was a sophmore). that was just such a fucked up day, my friend rusty died in that car accident, i wish i had said they could go ahead and come up to my house to smoke a couple bowls, i just didnt want to smoke seven fuckin kids up of only 2 that i actually liked.

in jeffco, that's where I live and have since '94, you can carry an ounce, but as I said it results in loss of marijuana and a 100 dollar fine. it is a petty offense; not even a misdemeanor.

I attended a private high school in denver, with a lot of my buddies from the conifer/evergreen area. We never found the cops in your woods to be dicks, maybe it was just luck, since our encounters were rare.

 

yeah, & it doesnt help when some of the people you roll with are known very well by them, like clay. if he had been there that night i know they would practically tear my car apart searching, clay has hidden shit in every place you can think of
