Busted by police and need help/advice

I'm looking for advice. It's a long story and hopefully you'll stick w/ me through it. I know I fucked up, and yes, I already know I'm a dumbass. I became too confident and careless. I'll try to tell this as accurately as possible.

Mother's Day - May 7, 2007:
I'm driving away from a friends house when I turn onto a main road from a residential road when I'm pulled over. I attempted to turn left where only a fucking right turn is allowed. I ended up going the right direction, but the PoLiCe was in the turning lane when I did it. It looked really akward, and he pulled me over. I'm shitting bricks about now as I know I'm fucked. The cop comes to the window, and tells me what I did wrong, blah blah, then says,

"Have you been smokin bud?"
"No sir, I haven't" (by the way, I wasn't lying)
"Don't lie to me. I'm gonna ask you one more time and what happens now will depend on your honesty. Do you have bud on you?
"Yes sir, under my seat" (he was going to search anyways bcuz of smell)

I gave him a half ounce of the dankest shit ever. The part that screws me, is that it was in multiple baggies, separated into 16ths and 8ths. Included was a scale and a few extra baggies. (And $6 in my wallet haha)
He gets me out of the car, handcuffs me, takes me to the substation where him and his fagget partner type the report full of lies and bullshit. They fabricated the story to no end. Anyways, a cop with half a heart found my Navy ID card in my wallet (I wasn't in the navy and I'm still not obviously). He said that's disappointing, and he told me to have someone pick me up and go home. He gave me a different cop's phone number and name and said I have to call it within 24 hrs or a warrant is issued. I got ahold of the guy, and he said the charges will be dropped if I 'cooperate'. We all know what that means. He told me he wants me to help him bust the bigger guys. Don't get mad just yet bcuz I'M NOT GOING TO DO IT.

I told him I don't know anybody at all!!! He was only interested in anything over pounds, pounds, pounds. I told him I don't know how to help. WELL, this was about 1 month before I started my 1 year probation for fighting, so I already had a lawyer. I told him the new story and he called the guy and said we can no longer communicate directly because I have a lawyer. I called the cop and he said we aren't supposed to be talking since I have a lawyer.

THAT WAS THE LAST I HEARD. It's been almost one full year and I've heard nothing. WTF is going to happen? This is trippin me out bcuz I'm just waiting for some fucken letter in the mail that says I'm summoned to court. (Which is the same thing that happened almost about a full year after the fight that I THOUGHT nothing ever became of. I'm worried as fuck, and I've had a 40 hr job, gone to college full time, not drank or smoked weed ONCE, and stayed outta trouble completely for the past year. Can't I tell the cop I've distanced myself from those types of 'people', and I can't help him anymore because I don't know any fucken meth or coke dealers or pounds of weed to help you with!!

Anyways guys, that's my story. I'm not a snitch either. I'm pretending to be trying to help him ok. I'm respectful as fuck towards this "detective" that I'm "working" with. I'm so fucken worried guys. Do you think the case got dropped or what? They have everything they need to convict me, so I wouldn't understand why they would drop it. Thanks for reading this long ass story. Please tell me your thoughts and give me some advice!!!!!!!!!!!! (yes i'm a dumbass and no i'm not going to snitch.)

 

your shit proly is gona be, nolle prosequi "be unwilling to pursue" they dont have shit youll get a fine and probation if they do. but Its been a year? Go to bed now and stop worrying.....lol..

 

lol I'm just fucken refreshing the page, hoping for answers haha. They have the hard evidence, and my statement - everything they need.

After my fight, a full year went by before I got a notice in the mail. Then it took 6 months to go through court. Then I got a year probation. So yeah, I'm just hoping this is going to be forgotten. Thanks for the reply orison, I somehow had a feeling the first one would be you haha

 

likely shit got lost on a trip to county records and your prosecution time is limited..
I would think they would only have a year on this type of case.. Then again I could be wrong..
Is it a Magistrate or Big Court? if its local cops and hasnt made ts way to county this song is over imo.. Judges can see through cop lies too.. They are not always on the cops side.. I only say this cause cops called me a Hot inspection sticker theif. meanwhile I purchased a car off a lot with stolen sticker.. Ok this had a spin Id rather not post about.. But the state police raided the car lot and the local cop calling me a car theif looked like a REAL ASSHOLE.. but I had to go to court to prove it.. show I just purchased the car a few months ago.. Cops didnt want to here it and bail was set at 10k. Still a major fucking head ache. So my life isnt all rosey sometimes. So I get interested in a little law. mainly cause Im surrounded by criminals, most are my best freinds.. kinda like jesus..lol..

 

Yeah, it's local police, although I'm not sure about the "detective" they refered me to. I have no idea if it's magistrate or crown court. After briefly reading, I don't know much about that. Would my charges be felony or misdemeanor? Probably felony, right?

I'm reading now, that if it's felony, prosecution time is 3 years from date of crime to conviction. Misdemeanor = 1 year.
I would be one lucky mother if I walked away and nothing became of this. Do you really think that's possible?

 

misdemeanor, intent to deliver is arguable...
1/2oz no more a fine than cruisin through a stop sign.

well Ive had traffic tickets vanish anythings possable....

 

when i got arrested for paraphanalla my court letter came in about a month and a half. And one tip , if you do get called down to court say your scale is for personal use only to make sure you dont get ripped off. Good luck man

what happened to a quick and speeding trial? can't the case be thrown out now since its been a year?

 

In most states the cops cant search your car unless they have consent from you or a warrant of some sort check your states laws it should be in there if they can or can't. it could help you or youre buddies if this incident happens again

 

Even if my car smells like weed? Cuz I won't lie, it did smell some strong fresh weed in my car. If that's the case, then I never did give him consent. Not officially. He TOLD me to get out...

cops do that even if they know the law because most people dont know about it but i think you have to give them consent even if the car smelt like weed

 

Depending on how backed up the courts in your area are, it could still be coming. A friend of mine got caught with underage alcohol and trespassing and it was a year and a month before he was formally charged.

But I wouldn't sweat too much, with any half-decent lawyer you could probably plead it down to mere possession and if you're already straight then probation will be a breeze.

Or you might get lucky. My possession charge of last December somehow got "lost".

 

what the fuck are you talking about? you NEVER "have" to give them consent. regardless of what state you´re in (for the US). even if you say you do not consent and they search anyways and find something, you can still use that in court to help you. otherwise, if you let them search and they find something, there´s nothing you can do. you basically gave it to them.

if you´re ever riding in the car with weed, put it in the trunk. have an emergency cigarette handy in case of being pulled over (even if you dont smoke). make an attempt to cover any smell in the car and your breath, but dont overdo it and let it be obvious.

even with probably cause, your car is like your house. unless you give them consent to enter, they cannot enter your house. same with the car.

 

Um, I don't think so. A cop can search your car only with consent, a warrant, or probable cause. The smell of marijuana constitutes as probable cause.

Same with your house.

 

no, I no for a fact that they can't search your house without consent. a friend had smoked weed with a window open and a passing by cop smelt it, knocked on the door, and then searched his house. he found an ounce of weed and arrested him. the case was thrown out because the cop was never given consent to enter.

 

I would have just denied search man. Smelling like bud isn't illegal apparently. And even so, you can have enough legal stalls so you can smoke it or get rid of it anyways...

 

yes, smelling like weed is not illegal, just having it on you is...
