Hey, I'm brand spankin' new here, I found this while reading up on marijuana legislation, but they bury this shit so deep you cant find it. I was busted at my 'high'(lol) school, with a sandwich baggie that i used to have my pipe in. I guess some ashes must have fallen out. Anyways, there was like less than a 20th of a gram of ASHES... not even resin, but ashes. This was like... 6 months ago, and given a 5day at-home suspension. This is the same punishment as someone who is caught with any drug. The thing I'd like to know is if I was actually guilty of posession. I did some research, and my school falls under the Controlled Drugs and Substances Act, same as anywhere else in Canada. Any intelligent stoners out there who could give a fellow stoner a hand? Oh maybe a bit of background for this little mishap too. Our vice principal is pretty much paid to bust stoners. He drives around in his piece of shit truck to all my normal blazing spots trying to bust me and my buds. So, we (Me, B, C, S, and L) were all blazing at the creek by our school, and we all got high, had a few laughs and went back to school. So, come the end of 3rd period, and the start of lunchtime C runs up to me and goes "Dude, get rid of your stash. VB has searched me and everyone else, he smashed S's pipe, and suspended all of us with any weed." AAAAAAAHHHHH!!!!! So, I shoved my big-ass nug the size of a football.... more like a branch really .... in my friends hidden pocket. The rest of the day went by without consequence. Next day however, VB calls me into his office. I'm cool as a cucmber, having left all my shit at home. (Porta-bong, grinder, Pink Floyd stash can ) So, he starts with the usual. By the way, I had just smoked 3 bowls out of my G-Bong before school, as usual. VB: "Where were you yesterday at break?" Me: "The smoke pit." VB: "So, you didnt go anywhere." Me: "Nope." VB: "Mind if I have a look through your backpack?" Me: "Go ahead. I have nothing to hide." So, he searches through all of my stuff wothout finding jack. Then he gets to my jacket pocket, and pulls out a ziploc baggie that I should have thrown out long, long ago. VB: "Dylan, what is this?" Me: "......." (OH FUCK. I HOPE THE THC HAS DECAYED BY NOW.) VB: "Dylan, what is THIS?" Me: "....tobbacco?" VB: " Look asshole, im going to give you one chance to change your story. If I find out you were lying to me, I can have you tried in court and sentenced for 3 years in juvy. So you can walk out that door and take your chances, or you can come clean. Every one of your friends ratted you out. They even said it was your pot they were smoking." Me: "I have no idea what you're talking about. I don't smoke pot. Pot is for hippies and the unemployed." VB: "I'm getting bad vibes from you right now." Me: "Are you really?" VB: "Have you ever smoked marijuana or hash?" Me: "I used to, till my parents found out." VB: "Your story's full of holes!! I could have you locked up right now!" Me: "Go for it." VB: "I tell you what I'm going to do. I'm going to have the contents of this bag analyzed, and if there is any trace of marijuana present, you will never attend class in this school district ever again." Me: "That's nice." *leave* As usual, he was completely full of shit. L got caught, and he is a total douchebag, so he ratted out the rest of us. VB, however, had no conclusive evidence on me. So, he resorted to bullshit intimidation tactics. I'm pretty sure I can't go to Juvy for an old sandwich baggie.He had me punished for possession of marijuana. Can he actually do this, or is this just him power-tripping and relying on me not to do some research? I really would like to get this stricken from my record, as I am generally a good student, and dont want to have this on my record. Peace + Pot, Dylan
So, where in Canada do you live? This sounds nothing like the Canada I Know. (Here in Ontario, that is.) I really doubt that he could do anything that is not within the school's powers. (i.e. suspend you). Your principal sounds like an ass. I don't think that any cop would care more than s/he had to pretend to care to keep his/her job. . .meaning, you get a firm warning. Boo to you. I wouldn't worry. Unless he's serious about expulsion. He was probably just trying to scare you though, anyway. He should get in trouble really. I don't think he would be allowed to lie to you, intimidate you, and interrogate you the way that he did. Try submitting a formal complaint perhaps, to the district school board or something. Get his ass expelled!

I don't know much about Canada, but I know staff in schools can do just about anything they want when it comes to the actual school (IE: If the princable thinks you diserve punishment for having some ash on you, youll get it) lol. But legally, a tiny bit of ash in a zip lock bag wouldn't get anywhere. I don't even think they could do anything to you for having a zip lock bag full of ash.

The prohibition in Canada extends to any form of marijuana/by-product that contains THC, CBD, etc. etc. As ash doesnt contain any THC, it isnt a problem. The Criminal Code (CDSA) states that residue, or trace amounts are "only evidence of a prior possession, and do not constitute a current possession. Hope that helps
