Can they arrest you for suspicion of being high, without evidence of possession? Would they piss test or blood test for weed? Are they doing this? Is it legal? I was camping in a spot that was 'illegal' and forest cop threatened me with Public Intox cause my eyes were red and he saw a couple of seeds in my tobacco box. His eyes would have been red too if he was out in the wind and weather for 3 days. Anyway, said he'd take me in for a blood test. WTF! Asked to search my car which was locked at a public parking spot. Of course I said no. Made a excuse my locks were broke. That's when he started making the threats. Ended up with a camping illegally ticket for $75.00. Anyone had this happen or any hear of anything like this?

Were you on public land when this guy harassed you? That is the only reason why. If you are not driving a car, you are not required to submit to any sort of drug testing, don't let a cop tell you any different.

Cool! Thanks. I didnt think they could make me submit to a blood test for red eyes while camping. I have heard if you get in a crash or kill someone they can blood test you. I was nervous as hell. Two forest cops a sheriffs deputy and a undercover. And it was Sunday morning. I was camped right under the reservoir cliffs with my art box and canvas out. He went thru all our gear while were gone for breakfast. Also, had a turkey roasting on the coals. Cop said he could give me a ticket for illegal fire. My friend and his girlfriend went to jail for Public Intox because they breathed alcohol. Drank a couple of screwdrivers. Not drunk. I had to lug all our gear up to the car up 1000 steps. Got stuck with dudes dog. Had to come up with bail money. None of us deserved the harassing bullshit those cops did. Terrible day. Will definitely be more stealth camping next time. I told my friend before we set the tent that we were in a bad spot but he said 'there's no signs we cant camp here'. No one listens to me. lol
bad luck to run into pigs on a powertrip. though you deserved the ticket for illegal camping/fire it is absurd that they went through your belongings,made threats and arrested your friends.

Around here in the state parks they want everyone in a tight circle where you pay $20 and there's nice paved roads and amenities. And you can only buy their 'official' firewood that the prison inmates chop. Its easier to keep an eye on the campers when they're in the designated area. I hate camping there. The forest cops walk around smelling for weed and looking for underage drinkers to bust. It was my fault for camping where they could see me. Next time I will be more stealth.

My understanding is if you're high in a public place, a cop is then warranted to be able to search you, however if you are high and don't have possession they can't legally take any action against you. However, I don't know if they can test you, or if the law is the same on private property You did the right thing to deny him searching your car, he has no authority to search your car UNLESS, you can see or smell evidence of illegal drugs, which any reasonable person would hide. Say you had weed in your glove box, even though its there, the cop is NOT allowed to search your car without your permission. Sometimes rules can change if you sign a form say for work or some legal document that allows a person to search/test for drugs based off of suspicion.
they would have to have a hearing in front of a judge to get a special search warrant to take your blood or anything. public intox is the only ticket you can get anyway. a misdemeanor. they cant go to a judge themselves either - they would have to go to the county attorney, talk him into it, the county attorney would have to make a motion requesting a bodily-invasive search warrant, he would have to get it scheduled with the judges clerk, then he would have to notify you of the date and time of the hearing, you would show up at the hearing, the judge would notice that you don't have a lawyer so he would reschedule it and sent you to the public defenders office to get you a lawyer assigned, then you would all show up at the hearing a few months later, the judge would notice that it is a misdemeanor, dismiss the warrant and probably give them a fine for wasting the courts time and the fact that so far this has cost the county probably around 5,000 dollars. cops bullshit all the time to get you to admit something or waive your rights. they solve a lot of murders that way, so its like ingrained in them. so never admit anything and ask if u r being detained or are u free to go, and if you are being detained that u do not wish to say anything w/o a lawyer.
Locally they recently passed some bullshit to make it illegal to drive under the influence of a cold. That's right, if you have a red stuffy nose and baked eyes they can book you.
druggies have a tendency to go to illegal/out of the way places to shoot up. people here drive into the woods and take all sorts of drugs. you shouldn't have been there suspicion - whether correct or otherwise was aroused.
I don't see the logic here...people shouldn't be out in nature because some druggies go out of the inhabited areas to do drugs?

I am remembering how here in N.J. some medical waste with syringes washed up on the beach and The Authorities blamed it on junkies shooting-up in the dunes.
