Running is fine. Ditching someone with illegal shit is not.
He ditched out without taking all the illegal shit, to save his own ass.
If his friend got busted, no warrant was needed, generally. It's a little grey, and that's how they like it. If someone fled a crime scene and left a phone, and his friend who stayed denied owning it, it's not hard in the least to go through it, no warrant needed.
If you grab the evidence and run, that's cool, if you run like a bitch and leave whoever's behind with illegal things, you screw them from the start.

There's no need for more than one person to be charged, but that would be the case even if he didn't run, if they both stuck to a story. Since he ran, there was no reason for ANYONE to get in ANY trouble, except that he's a douche.
