A good friend of mine was recently being investigated for the premeditated murder of one of his best friends. He was the last person to see the deceased alive, and his finger prints were found on shell casings at the scene. The case has been dropped by lack of means and motive. It was decided that the fact that his prints were on the shell casing is inconclusive evidence that he in fact was the shooter.
Right now he's serving a two year bit for robbery and conspiracy. The appeal is looking good. No witness will testify to having seen him actually enter the residence on that evening and because he looks identical to his brother with the exception of size many witnesses are unable to distinguish which one they saw outside the house that evening. My other friend was found with the stolen items in her home, and has been positively IDed by neighbors. The defense for friend number one is attempting to get the charge dropped to conversion because he was in the house of the woman that was identified and caught with the items in her home. If the case gets reversed and the charge changed, he will have completed his time and be released immediately.
