which is more important the 1st of 5th amendment?

    Of the two free speech is more important. If you get summoned to court and don't speak even to confirm your name you could be convicted of contempt of court. Therefor there is no real right to remain silent.

    Free Speech! Most places that don't embrace free speech want you to remain silent anyways so free speech. Truly the best!

    I agree, free speech is definately more important. But I also agree with
    wa bluska wica, it seems our freedom has been limited.

    Even here (HF) free speech is limited ... I've had two threads deleted. :mad:

    If people don't complain when stuff like this happens it's YOUR freedom you're ALLOWING to be taken away. It's important IMO to ALWAYS stand up for freedom - for everyone - in all circumstances. Otherwise YOUR rights will be eroded, and before you know it YOU will be living in a completely fascist worse-than Nazi Germany state. Time to choose is running out quickly. :nopity:

    The liberty to speak or be silent are the same rights, imo. Just like the right to or from religion, sex, drugs, press, property, slurpies, life, death, etc. Forced speech is not free speech.

    Also, there is no "free speech" on forums, for the numnuts claiming to be "censored" on the forums. This is a privatley owned websites and those who own it or represent those who own it have the right to keep or delete whatever they want. Its called the right to property and its just as important as every other right, for example, free speech. You even agreed that they could delete your posts or ban you from posting here, if you broke their rules, when you first signed up here. *Sigh*

    Lemme elaborate some. What if you were in your home and you invited a guest over for dinner. Then all of a sudden the guest starts yelling obsenities about your mother, starts hitting on you daughter, and then starts denying the holocaust after finding out that you have Jewish ancestory. Should you have the right to figuratively kick his hiney outta your house...or do you have to protect the right of his free speech? Forums aren't any less of private property than your home is and if you can't respect the right to property and privacy of its owners then why should anyone respect yours?

    free speech for sure. u could even argue that free speech is the right to give no speech at all but ill leave that out of this. had we not had the 5th amendment but had the first we would be able to say that we want the right to be quiet and could use our speech to influence those to see it our way. on the other hand had we only had the 5th amendment and no 1st we would have no right to say we want free speech. all we could do was sit there and not answer questions.

    Who would want to keep silent if they all have so much to say? And if you plead the fifth, it just proves that you're guilty.

    I think i originally voted for free speech, but i think now I'd go for the right to remain silent.

    think about how awsome that right is; a cop can ask you anything and they can't force you to incriminate yourself. fucking genius.

    It's careless to say "the right to remain silent". The 5th Amendment says "No person ... shall be compelled in any criminal case to be a witness against himself." So, this only applies in a criminal case.

    Perhaps you're confusing this with the Miranda Rights?
